amended by section 313 of the surface transportation assistance act of 1978 and by section 301 of the surface transportation act of 1982.

For

payment by the state of the share of the federal government for public mass transportation operating assistance and capital projects and transit-related technical support services or special studies undertaken by participating localities or by the department of transportation on behalf of localities through contractual arrangements with private carriers, private nonprofit corporations or consultants, in accordance with a

pro

gram approved by the federal government. No monies shall be available for expenditure from this appropriation until a written repayment agreement has been entered into between the commissioner of transportation and the director of the budget.

Upon the issuance of a segregation of funds by the director of the budget, the department of transportation is hereby authorized to pay the federal share of the section 18 projects as may be required to meet programmed expenditures in accordance with approved grant agree

ments.

The comptroller is hereby authorized to receive from the federal government, and to deposit to the credit of the general fund, amounts of money equal to the expenditures herein authorized so that the state is reimbursed in full for any and all such payments

the federal share of transportation planning programs in state urban areas as authorized by the urban mass transportation act of 1964 as last amended and by section 104(f), Title 23, United States Code. For payment by the state of the share of the federal government for continuing comprehensive transportation planning and coordinated support transit studies undertaken as part of the unified work programs of participating local planning or municipal agencies in accordance with grant agreements approved by the urban mass transportation administration or the federal highway administration. No monies shall be available for expenditure from this appropriation until a written repayment agreement has been entered into between the commissioner of transportation and the director of the budget. Upon the issuance of a segregation of funds by the director of the budget, the department of of transportation is hereby authorized to pay the federal share of approved work programs to local planning or municipal agencies, or for payment to consultants for the cost of studies included in approved work programs, periodically as may

be required to meet programmed expenditures in accord-
ance with approved grant agreements and to furnish plan-
ning, administrative and professional services or to
supplement the appropriation herein authorized with ap-
propriations from the general fund state purposes ac-
count in sum total not to exceed seventy-five percent of
the nonfederal share of programmed expenditures in ac-
cordance with unified work programs of local planning or
municipal agencies.

The comptroller is hereby authorized to receive from the
federal government, and to deposit to the credit of the
general fund, amounts of money equal to the expenditures
herein authorized so that the state is reimbursed
full for any and all such payments

LONG ISLAND RAIL ROAD FREIGHT ASSISTANCE

General Fund

Local Assistance Account

For the costs, to the extent necessary, of state financial
assistance to the metropolitan transportation authority
for the operating expenses of Long Island rail road
freight services during the state fiscal year 1985-1986.
Notwithstanding the provisions of any other general or
special law, no part of the moneys herein appropriated
shall be available for expenditure until a certificate
of approval shall have been issued by the director of
the budget,
budget, and a copy of such certificate filed with
the state comptroller, the chairman of the senate
finance committee and the chairman of the assembly ways
and means committee. Such certificate
may be amended

from time to time by the director of the budget and a
copy of each such amendment shall be filed with the
state comptroller, the chairman of the senate finance
committee and the chairman of the assembly ways and
means committee.

The commissioner of transportation may prescribe, subject to the approval of the director of the budget, such regulations as he deems necessary and appropriate to effectuate the purposes of this appropriation, including but

not limited to the utility and cost effectiveness of the services. The Long Island rail road shall not receive assistance for freight services for a period greater than nine months unless the railroad shall have developed a plan of action as approved by the commissioner which shall demonstrate the ability of the freight operation to operate independent of continued state assistance within three years of first receiving state assistance under this appropriation.

In no event, however, shall the railroad receive state operating assistance payments for a period longer than three years

For the costs, to the extent necessary, of operating assistance payments or capital reconstruction or rehabilitation of rail freight facilities pursuant to section 14-d of the transportation law.

The commissioner of transportation may prescribe, subject to the approval of the director of the budget, such regulations as he deems necessary and appropriate to effectuate the purposes of this appropriation, including but not limited to the utility and cost effectiveness of the services. No rail freight facility shall receive assistance for a period greater than nine months unless such facility shall have developed a plan of action as approved by the commissioner which shall demonstrate the ability of the facility to operate independent of continued state assistance within three years of first receiving such state assistance.

In no event,

however, shall a rail freight line receive state operating assistance payments for a period longer than three years
