An act for allowing further time for inrollment of deeds and wills made by papifts, and for relief of proteftant purchafers.

WH

HEREAS by a clause in an act of parliament, passed in the third year of the reign of his late majesty King George the A&t 3 Geo. 1. First, intituled, An act for explaining an act, paffed in the laft feffion of parliament, intituled, An act to oblige papifts to register their names and real eflates; and for enlarging the time for luch registering; and for fecuring purchases made by protestants'; it was enacted, That, from and after the twenty-ninth day of September, in the year of cur lord one thousand feven hundred and feventeen, no manors, lands, tenements, hereditaments, or any intereft therein, or rent or profit thereout, should pass, alter, or change, from any papist, or person profeffing the popish religion, by any deed or will, except fuch deed, within fix months after the date, and fuch will, within fix months after the death of the teftator, should be enrolled in one of the King's courts of record at Westminster, or else within the fame county or counties wherein the manors, lands, and tenements lie, in fuch manner as therein, for that purpose, is particularly directed: and whereas by several acts of parliament, made in the tenth year of his faid late Majesty's reign, and in the third, fixth, ninth, eleventh, twelfth, fixteenth, nineteenth, twenty-first, twenty-eighth, thirty-first, and thirtythird of his late majesty King George the Second; and the fecond, fourtb, and seventh years of his present Majesty's reign, it was enaded, That every deed and will, made fince the twenty-ninth day of September, one thousand seven hundred and feventeen, in order to pass, alter, or change, any manors, lands, tenements, or hereditaments, or any intereft therein, or any rent or profit thereout, from any papist, or per/on profeffing the popish religion, to any proteftant or proteftants, or by reafon of which deed or will any proteflant or proteftants may claim or derive any legal, equitable, or other intereft whatsoever, to his, her, or their ufe, for his, her, or their benefit, or to the use or benefit of any other proteftant or proteftants, though not inrolled, or not inrolled in due time, fhall be as good and effectual in law as the fame would have been in case the said deeds and wills had been inrolled within the times limited, by the faid claufes in the faid acts, for the inrollment thereof; provided the said deeds and wills fhould be inrolled on or before the refpective times in the faid feveral acts for that purpose mentioned, in fuch manner as by the faid claufe in the first mentioned act is directed: be it enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, Deeds and and by the authority of the fame, That every deed and will, wills of pa- made fince the twenty-ninth day of September, one thoufand piits,etc. made feven hundred and feventeen, in order to pafs, alter, or change, fince Sept. 29. any manors, lands, tenements, or hereditaments, or any intereft 3717, to be therein, or any rent or profit thereout, from any papist, or perfon profeffing the popish religion, to any proteftant or proteftants, or by reafon of which deed or will any proteftant or pro

testants may claim or derive any legal, equitable, or other interest whatsoever, to his, her, or their ufe, for his, her, or their benefit, or to the ufe or benefit of any other proteftant or proteftants, though not inrolled, or not inrolled in due time, fhall be as good and effectual in the law as the fame would have been in case the faid deeds and wills had been inrolled within the times limited, by the said claufes in the faid acts, for the inrollment thereof; provided the fame deeds and wills fhall be inrolled on or before the first day of January, one thousand feven hundred and seventy-nine, in fuch manner as by the said claufe in the faid firftmentioned act is directed.

II. Provided always, That nothing herein contained fhall This act not extend, or be conftrued to extend, to make good any fuch to extend to deeds, etc. deed, will, or lease, already made and not inrolled, of the want the validity of inrollment whereof advantage fhall have been taken on or whereof has before the second day of June, one thousand seven hundred and been brought seventy-feven; but every fuch deed, will, or lease, shall remain in question of fuch force and effect only, as the fame would have had if this before June 2, act had never been made, and of none other force and effect.

churchwardens and overfeers therein mentioned, or the greater part of them, by the affent of any two justices of the peace, to bind the children of all fuch parents who shall not, by the faid churchwardens and overfeers, or the greater part of them, be thought able to keep and maintain their children, to be apprentices, where they fhall fee convenient, till fuch man-child fhall come to the age of four and twenty years, and fuch woman-child to the age of one and twenty years, or day of marriage: and whereas it has been found by experience, that the faid term reSpecting men-children is longer than is necessary, and that if fuch manchild was bound to be an apprentice only till he came to the age of one and twenty years, all the benefits intended by the faid act would be preferved, the hardships brought on fuch parish apprentices, by the length of their apprenticeship, would be avoided, and the good harmony between master and apprentice would be better maintained; may it therefore please your Majesty that it may be enacted; and be it enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this present parliament affembled, and by the authority of the fame, No child ap. CA P. XLVIII.

An act for impowering the mayor, aldermen, and commons, of the city of London, in common council affembled, to raife. upon the credit of the furpluffes to arife out of a certain fund, commonly called the orphans fund, the fum of forty thousand pounds, towards difcharging the debt incurred in rebuilding the gaol of Newgate, and a feffions-house adjo1ning, and for completing the faid gaol, and building an infirmary thereand other the purposes therein mentioned.

Preamble. Recital of acts 5 and 6 Gul. & Mar. 21 Geo. 2, 29 Geo. 2. and 7 Geo. 3. On July 5, 1766, 58,500l. wanted to complete Black-friars bridge, etc. 7.500l. for embanking the Thames; 30,000l. for redeeming the tolls of London-bridge; 50,000l. for building Newgate, and 10,000l. for repairing the Royal Exchange. Recital of the powers granted to the corporation of London by the A&t of 7 Geo. 3. 156,000l. to be borrowed, at 31. 10s. per cent. per ann. for the purpoles before-mentioned. The fund established by act 5 & 6 Gul. & Mar. charged with the payment of monies thentofore borrowed, and also the said tum of 156,000l. And to render the said fund fufficient to pay off the faid debts, the duty of 6d. per chaldron on coals and culm was further continued for 46 years, etc. The order in which the different payments were to be made out of the fund. How the furpluffes were to be disposed of. Court of aldermen were to give fix months notice of their intention to pay the respective fums borrowed, or to redeem the annuities, etc. In cafe of any deficiency in the faid fund, the fame to be fupplied out of the chamber of London. Recital of the progress made in building a new gaol, and the expence thereof. An infirmary wanted. Common council impowered to complete the new gaol, and to build an infirmary adjoining thereto; and for that purpose to raise 40,000l. upon the orphans fund. Contributors to be intituled to redeemable annuities at 4l. 10s. per cent. per ann. Common council to give bonds for such annuities, affignable by indorsement. The annuities to be charged on the orphans fund. Surpluffes of the faid fund how to be applied. Upon fix months notice of redemption of annuities, and

and tender of the money, the annuities to cease; but the principal to be ftill payable. Deficiencies in payment of intereft, to be supplied out of the chamber of London. The 40,000l. to be applicable only for the purposes of this act : The furplus (if any) to be applied to increase the fund. Chamberlain to keep accounts of receipts and disbursements. Common council impowered to appoint officers; and allow them falaries. Officers concerned in the receipt of money to give fecurity. Penalty on officers milapplying any of the faid monies. City anfwerable in case of any mifapplication by them. Amerciaments, etc. against the city to be applicable to the uses of this act, and not to be discharged, etc. Disbursements of the 40,000l. to be included in the chamberlain's annual account. Bonds, etc. not able to any duty. Tais act not to affect any of the city's prelent creditors Prifoners may be removed. Limitation of actions. General iffue. Trebie colts. Public act.

CA P. XLIX.

An act for applying the sum of one thousand pounds, to arise out of the furpluffes of a certain fund commonly called the Orphans Fund, for the purpose of opening communications between Wapping street and Ratchff-highway, and between old Gravel-lane and Virginia-street, within the arishes of Saint George and Saint John of Wapping, in the county of Middlesex,

Preamble. Recital of 17 Geo. 3. C. 22. and act 5 & 6 Gul. & Mar. City of London to pay 45l. per annum to the treasurer of the commiffioners under the first recited act. Bonds to be given for fecuring the payment of the annuity, and delivered to the treasurer. Bonds to be numbered, and may be fold. Application of the money arifing by fuch fale. Holders of bonds may bring actions thereon. Annuities to be redeemable by the city on fix months notice. Orphans fund charged with the annuities. Pub. lick act.

An act for applying the fum of one thousand five hundred pounds, to arise out of the furpluffes of a certain fund, commonly called the Orphans Fund, for the purpose of widening certain avenues leading into Ĝoodman s Fields, in the county of Middlefex.

Preamble. A&t 5 & 6 Gul. & Mar. recited. City of London to pay an annuity of 671. 10s. to the commiffioners; and for that purpose to issue bonds under their common feal. Value and condition of the bonds. Bonds to be be numbered, and may be fold. Application of the money arifing from fale thereof. Annuities to be redeemable by the city on fix months notice. An act for applying the fum of four thousand pounds, to arife out of the furpluffes of a certain fund, commonly called the Orphans Fund, towards completing the paving of the town and borough of Southwark, and certain parts adjacent, in the county of Surrey.

Preamble. Recital of act 6 Geo. 3. and act 5 & 6 Gul. & Mar. City of London to pay an annuity of 180l. to the commiffioners under the first recited act; and for that purpose to iffue bonds under their common feal. Value and condition of the bonds. Bonds to be numbered, and affignable by indorsement. Application of money arifing from the bonds, Annu. ities to be redeemable by the city on fix months notice. The orphans fund charged with the payment of the annuities. Intereft of 41. 10s. per cent. to be allowed for money advanced to pay the expences of this act. Publick act.
