CA P. XXII.

An act to continue feveral laws relating to the giving further encouragement for the importation of naval ftores from the British colonies in America, to the landing of rum or foirits of the British Sugar plantations before payment of the duties of excife; to the difcontinuing the duties payable upon the importation of tallow, hogs lard, and greafe; to the regulating the fees of officers of the cuftoms and naval officers in America; to the allowing the exportation of certain quantities of wheat, and other articles, to his Majefty's fugar colonies in America; and to the allowing a drawback of the duties on rum fhipped as flores to be confumed on board merchant ships on their voyages.

HEREAS the laws herein-after mentioned have by experience been found ufeful and beneficial, nd are near expiring; may it therefore pleafe your Majesty that it may be enacted: and be it enacted by the King's molt excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That fo much of an act, made in the eighth year of the reign of King George the First, intituled, in act for giving further encouragement for the importation of naval tores, and for other purposes therein mentioned, as relates to the importation of wood and timber, and of the goods commonly called lumber, therein particularly enumerated, from any of his Majefty's British plantations or colonies in America, free from all customs and impofitions whatsoever, which was to be in force for twenty-one years from the twenty-fourth day of June, one thousand seven hundred and twenty-two; and which by feveral fubfequent acts, made in the fixteenth, twenty-fourth, and thirty-first years of the reign of his late majesty King George the Second, and the fourth and twelfth years of his prefent Majefty's reign, was further continued until the twentyninth day of September, one thousand seven hundred and seventyeight, and from thence to the end of the then next feffion of parliament, fhall be and the fame is hereby further continued from the expiration thereof, until the twenty-ninth day of September, one thousand seven hundred and eighty-five, and from thence to the end of the then next feffion of parliament.

II. Provided nevertheless, and it is hereby further enacted by the authority aforefaid, That a due entry of fuch goods fhall be first made in the custom-houfe belonging to the port where the cultom-house fame fhall be imported, in the fame manner and form, expreffat the place of ing the quantities and qualities of the respective goods, as was importation, ufed and practifed before the making of the faid recited act;

and the faid goods fhall be landed in the prefence of the proper officer appointed for that purpose, otherwife fuch goods fhall be liable to the payment of the like duties as would be due and payable for the fame, at the times of the importation thereof, if the faid recited act had not been made; and it fhall and may

be lawful for any officer of the customs to stop such goods, and fecure the fame in his Majefty's warehoufe till fuch duties are accordingly paid; and if the fame fhall not be paid within fix months after the faid goods are brought to fuch warehouse, they fhall and may be fold, and the produce thereof applied in the fame manner as other goods, which are brought to his Majefty's ftorehouses for fecurity of the duties, may, by the laws now in force, be fold and difpofed of, any thing in the faid recited act, or any other act, to the contrary notwithstanding.

III. And be it further enacted by the authority aforefaid, Part of an act That fo much of an act, made in the fifteenth and fixteenth years of the reign of his late majesty King George the Second, intitled, relating to the landing of An act to impower the importers or proprietors of rum or fpirits of the rum, &c. beBritish fugar plantations, to land the fame before payment of the duties fore payment of excife charged thereon, and to lodge the fame in warehouses at their of the duties own expence, and for the relief of Ralph Barrow, in respect to the duty on fome rock falt, lost by the overflowing of the rivers Weaver and Dane; as relates to the landing of rum or fpirits of the British fugar plantations, before payment of the duties of excife, and to the lodging of the fame in warehouses, at the expence of the importers or proprietors thereof, which was to continue in force from the twenty-ninth day of September, one thoufand feven hundred and forty-two, to the twenty-ninth day of September, one thousand seven hundred and forty-nine, and from thence to the end of the then next feffion of parliament, and which, by feveral subsequent acts of the twenty-third and thirtyfirst years of the reign of his said late Majefty, and the fourth and eleventh years of the reign of his prefent Majefty, was further continued until the twenty-ninth day of September, one thousand seven hundred and feventy eight, and from thence to the end of the then next feffion of parliament, shall be, and further contithe fame is hereby further continued from the expiration thereof, nued till Sep. until the twenty-ninth day of September, one thoufand feven 29, 1785, &c. hundred and eighty-five, and from thence to the end of the then next feffion of parliament.

IV. And be it further enacted by the authority aforefaid, A&t, Geo 1. That an act, made in the feventh year of the reign of his prefent relating to the Majesty, intituled, An act to difcontinue, for a limited time, the duties on imduties payable upon the importation of tallow, hogs lard, and greafe, Portation of which was to be in force for three years, from the twenty-fifth day of March, one thousand seven hundred and fixty-seven, and from thence to the end of the then next feffion of parliament; and which, by feveral fubfequent acts, of the tenth, thirteenth, and fixteenth years, of the reign of his prefent Majefty, was further continued until the twenty-fifth day of March, one thoufand feven hundred and feventy-nine, fhall be, and the further contifame is hereby further continued from the expiration thereof, nued till March 25, until the twenty-fifth day of March, one thousand feven hundred 1782. and eighty-two.

For encouraging the exportation of rum and fpirits of couraging the the growth, produce, and manufacture, of the British fugar exportation of rum, etc. the plantations in America, from this kingdom, as ftores to be fent produce of the and confumed on board in any voyage to parts beyond the feas; British fugar be it enacted by the authority aforefaid, That during the term plantations, to of two years from and after the paffing of this act, the fame drawbacks and allowances which are given by any former act or acts of parliament now in force on the exportation of fuch rum to parts beyond the feas, as merchandize, fhall be allowed and paid to the merchant or merchants, on his, her, or their fhipping any fuch rum as ftores to be spent and confumed on board in any voyage to parts beyond the feas; and when any merchant or merchants fhall be defirous of fhipping any fuch rum as ftores, as aforesaid, and fhall give five days notice thereof to the respective commiffioners of excife, for the time being, or to fuch other person or persons as they fhall, from time to time, api point

point for that purpose, mentioning in fuch notice the exact destination of the intended voyage, the tonnage of the fhip or veffel, and the number of the mariners intended to be employed in navigating the fame, and also the number of his Majelly's troops that may hereafter be embarked in the fame; it thall and may be lawful to and for the faid commiffioners of excife, or the perfon or perfons fo to be appointed by them as aforefaid, to afcertain the quantity of fuch rum which fhall be shipped on board fuch fhip or veffel as ftores, and for which fuch drawback and allowance fhall be paid and made; and also the size and marks of the cafk or cafks in which such spirits fhall be fo fhipped; and on oath being made, before one or more of the faid commiffioners of excife, or juftices of the peace for the county or place from whence any fuch rum is intended to be exported, or before fuch other person or perfons as fhall be authorised as aforefaid by the said commiffioners of excife for that purpofe, that the fame are to be shipped as ftores, to be spent and confumed in the voyage, the merchant or merchants fhipping the fame shall be paid the fame drawbacks, and have the fame allowances for rum fo fhipped, as if fuch rum had been exported as merchandize: provided always, That neither the faid Drawback not draw-back or allowance, or any other drawback or allowance, to be allowed shall be made or paid for any quantity of fuch rum which fhall be exported in a exported or shipped for ftores as aforefaid, in any cafk which calk containfhall contain lefs than one hundred gallons; nor fhall any fuch ing less than drawback or allowance whatsoever be made or paid for any 100 gallons, quantity of rum which shall be so exported or fhipped for ftores as aforefaid, on board of any veffel or veffels of leís burthen than one hundred tons; but that all fuch rum fhall be exported and shipped, in all refpects not otherwife directed by this prefent act, under the fame rules, regulations, and penalties, as are prescribed by any former act or acts of parliament now in force, relating to the exportation of fpirits, drawn or made in Great Britain, as ftores to be spent and confumed aboard in any voyage to parts beyond the feas.

CA P. XXIII.

An act more effectually to enable the prefident and governors of the hospital or infirmary at Bath, established by an act, passed in the twelfth year of the reign of his late majefty King George the Second, intituled An act for establishing and well-governing an hofpital or infirmary in the city of Bath, to take or acquire, and hold, any lands, tenements, or hereditaments, or any intereft in lands, tenements, or hereditaments, and any money or perfonal property, to be laid out in lands, tenements, or hereditaments, pursuant to any will, or otherwise, to the amount limited in the said act.

Preamble. Recital of act 12 Geo. 2. The governors of the hofpital were incorporated. Yearly income of the hofpital about 560l. d. Deviles, &c. deemed valid, although not made conformable to ftatute of mortmain. Hospital eftate not to exceed the fum limited by former act. General saving. "Publick act.

CA P. XXIV.

An act for charging the lands within the north level, part of the great level of the tens called Bedford Level, and divers lands adjoining thereto, in the manor of Crowland, with further taxes, for a limited time, for difcharging the debts incurred by the commiffioners under an act of the twenty-leventh year of King George the Second; and for the better fupporting and preferving the drainage of the faid lands.

Preamble. Recital of acts 15 Car. 2, and 27 Geo. 2. By the last mentioned act, the north level and Portland, were divided into five districts; and commiffioners appointed, who were impowered to lay taxes not exceeding 1 s. per acre for the firft four years, and 6 d. per acre afterwards; and to borrow 14,000l. That fum borrowed, and applied pursuant to that act, and to another act of 15 Geo. 3. Act 29 Geo, 2. impowered the corporation to borrow 5,000l. more. Recital of act 11 Geo. 3. The 5,000l. borrowed and expended, and other debts contracted. The lands in the north level charged with a further tax of 6 d. per acre, and Portfand d. per acre, payable to the corporation. The taxes, and money borrowed thereon, to be applied to the corporation works belonging to the north level. The corporation impowered to borrow the further fum of 20.000l.; which was borrowed accordingly. The revenues, after keeping down the interest of the debts, are in lufficient to support the works; which, without further aid, will foon be in danger of breaking. The lands in the north level charged with a further tax of 1 s. per acre, and Portland with 6 d. per acre, for nine years, payable to the commiffioners. New taxes to be applied with former taxes; viz. to keep down the intereft of the debt of 14,000l. and in the gradual discharge of that debt; and to the support of the works. The lands in the north level charged with a further tax of 4 d. and Portland of 2 d. per acre, for the like term of nine years, payable to the corporation: to be applied to the works of the corporation belonging to the faid north level. Quantities of the lands how to be taken. Accounts to be delivered in of the names of tenants, and quantities of lands. How to proceed when owners neglect to deliver in accounts, or fhall deliver fufpicious accounts. Taxes to be paid by the occupiers. Tenants at rack rent to deduct the fame out of their rents: but not leffees holding beneficial leafes. Power of diftrefs, for recovery of the taxes. If arrears, etc. are not paid, or goods replevied, within five days, they may be fold. Unoccupied lands to remain a fecurity. Limitation of actions. General iffue. Double colts. General faving.
