CAP. VIII.

An alt for providing necessary carriages for his Majefly in his royal progrefs and removals.

WH

HEREAS by an act of parliament in the twelfth year of his Majesty's reign, intituled, An act for taking away the court of wards and liveries, and tenures in Capite and by knightsfervice, and purveyance, and for fettling a revenue upon his Majefty in lieu thereof, it was (amongst other things) enacted for the reafons and recompence therein expreffed, That from thenceforth no perfon or perfons, by any warrant, commiffion or authority under the great feal or otherwife, by colour of buying, or making provifion or purveyance for his Majefty, or any Queen of England, for the time being, or of any the children of any King, or Queen of England, that shall be, or for his, their, or any of their houshold, fhall take any cart, carriage or other thing whatsoever of any of the fubiects of his Majesty, his heirs or fucceffors, without the free and full confent of the owner or owners thereof, had, and obtained without menace or enforcement, (2) nor shall fummon, warn, take, use or require any the said subjects to furnish or find any horses, oxen or ather cattle, carts, ploughs, wains or other carriages, for the ufe of his Majefty, his heirs or fucceffors, or of any Queen of England, or of any child or children of any of the Kings or Queens of England from the time being, for the carrying the goods of his Majefty, his beirs or fucceffors, or the faid Queens, or children of any of them, without fuch full and free confent, as aforefaid, any law, ftatute, custom or ufage to the contrary notwithstanding; (3) which at may prove very prejudicial and inconvenient to the Kings majesty in his royal progreffes upon his neceffary occafions to feveral parts of this realm, in cafe any perfon or perfons fhall obftinately refufe voluntarily to provide fufficient carriages for royal fervice at ordinary and usual rates for fuch carriages, as are paid by others of his subjects in fuch places, contrary to the true intent and meaning of the faid act.

II. Be it therefore enacted by the Kings most excellent majesty, by and with the advice and confent of the lords and commons in this prefent parliament affembled, That the clerk, or chief officer of his Majefties carriages, fhall three days at

The greencloth, give notice in writing to two or more of his Majefties cloth to projuftices of the peace next adjoining, to provide fuch a number &c. for his of carts and carriages from the plaçes next adjacent, as his Ma- Majefty's ufe. jefty fhall have prefent ufe of, expreffing the certainty of that number, as alfo the time and place, when and where the faid carts and carriages are to attend; which carriages fhall confift of four able horses, or fix oxen, or four oxen and two horfes; for each of which cart or carriage, the respective owners fhall receive fix pence for each mile they fhall go laden (2) and that in cafe any of his Majefties fubjects Penalty for of this realm hall refufe to provide and furnish his Majefty refufing to that now is, or his Queen that fhall be, or his or her houf- furnish his hold, in their progrefs or removals, with fuch fufficient and Majesty. neceffary carriages for their wardrobe and other neceffaries, for ready monies tendered to them; or fhall without just and reasonable cause refuse to make their appearance with fuch fufficient carts and carriages, as are before expreffed; that then upon due proof and conviction of fuch neglect and refusal, by the oath of the conftable or other officer, or two other credible witneffes, before the faid juftices of the peace of the county, or mayor, or other chief officer of the city or corporation where he or they inhabit, (which oath they thall have power to adminifter) the party fo refufing, fhall for fuch his refufal and neglect forfeit the fum of forty thillings to the Kings majesties ufe, to be forthwith levied by distress and sale of his goods and chattels (rendering to the parties the overplus upon every fuch fale, if there fhall be any) by warrant from the faid juftices of the peace, mayor or other chief officer.

III. Provided always, That no horfes, oxen, cart, or wain, No horfes or fhall be enforced to travel above one days journey from the carriages to place where they received their lading, and that ready pay-day's journey, travel above a ment fhall be made in hand for the faid carriages at the place nor without of lading, without delay, according to the aforefaid rates: (2) and pay of ready in cafe any juftice of the peace, mayor, chief officer or conftable, money. fhall take any gift or reward to fpare any perfon or persons from making fuch carriage, or fhall injuriously charge or grieve any perfon through envy, hatred, or evil will, who ought not to make fuch carriage, or fhall impress more carriages than he fhall be directed from the green-cloth to do, That then upon due proof and conviction thereof, the party fo offending fhall forfeit the fum of ten pounds to the party thereby grieved, or any other who fhall fue for the fame, to be recovered by action of debt in any of his Majesties courts of record; wherein no effoin, protection or wager of law fhall be allowed: (3) and in cafe any perfon or perfons fhall prefume to take upon Penalty for him or them to imprefs any horfes, oxen, cart, wain or car- wrongful charging any riages for his Majefties fervice, or other than the person so im- perfon. powered, then he or they fo offending, fhall upon due conviction of the faid offence, incur and fuffer the punishment contained in the first recited act.

IV. And whereas of late in his Majefties progreffes, exceffive rates and prices have been exacted from his Majesties fervants for lodging, horse-meat, ftable-room and other accommodations : (2) be it therefore enacted by the authority aforesaid, That none of his Majefties faid fervants fhall be compelled to pay above one fhilling by the night for every bed that they fhall ufe for themselves, nor above fix pence by the night for every bed that they fhall ufe for their fervants: (3) and that in all fuch houses where any of his Majefties faid fervants fhall pay for their diet, or for hay and provender for their horfes, convenient lodging fhall be provided for themselves and their fervants, without paying any thing for the fame.

V. And be it further enacted by the authority aforefaid, That any two or more of the juftices of the peace near adjoining to juftices of the the road through which his Majefty is to pafs, fhall immediately after notice in writing from the faid green-cloth, and avenor, under their hands and feals fet down and appoint such reafonable rates and prices to be paid during his Majesties abode there, both for hay and oats, and other accommodations for horfes, as they in their difcretion fhall think meet; which rates, one day at the least before his Majefties coming to fuch place, the faid juftices fhall caufe to be proclaimed in the market town next to fuch place, and in fuch of the neighbouring towns and villages as to them thall seem meet, to the end that notice may be taken of fuch rates and prices: (2) and if any perfon fhall take any other fum than what is, or fhall be fo limited, either for lodging, horse meat, ftable room, or other fuch accommodations, and be thereof convicted by confeffion of the party, or by the oath of one credible witnefs, before any one juftice of the peace, (which oath the faid juftice of the peace is hereby authorized to adminifter) that then in fuch cafe every perfon fo offending, fhall forfeit and pay to the party grieved, the fum of forty fhillings; the fame to be levied by diftrefs by warrant from the faid juftice of the peace, and fale thereof, returning the overplus to the party (the charge of the diftraining being first deducted;) (3) this act to have continuance till the end of the first session of the next parliament, and no longer.

CAP. IX.

An alt for the establishing articles and orders for the regulating and better government of his Majesties navies ships of war, and forces by fea.

FOR the regulating and better government of bis Majefties navies,

fhips of war forces by fea, wherein under the good providence and protection of God, the wealth, fafety and firength of this kingdom is fo much concerned, (2) be it enacted by the Kings most excellent Majesty, with the advice and confent of the lords and commons in this prefent parliament affembled, and by the authority thereof, That all and every the articles and orders in this act mentioned, fhall be duly and respectively put in execution, obferved and obeyed in manner hereafter mentioned.

II.

VI.

upon the offenders therein, as the quality of their offence and
mifdemeanor fhall be found to deserve, and the court-martial
fhall impose.
VII.

None in his Majefties pay fhall take out of any prize, or ship, or goods feized on for prize, any money, plate, goods, lading or tackle, before judgement thereof firft paft in the admiralty court, but the full and intire accompt of the whole, without imbezilment, shall be brought in, and judgment paft intirely upon the whole, without fraud, upon pain of such punishment as fhall be impofed by a court-martial, or the court of admiralty; excepting that it fhall be lawful for all captains, fea-men, foldiers and others, ferving as aforefaid, to take and to have to themselves as pillage, without further or other accompt to be given for the fame, all fuch goods and merchandizes (other than arms, ammunition, tackle, furniture or ftores of fuch fhip) as fhall be found by them, or any of them in any fhip they shall take in fight or prize) upon or above the gun-deck of the said ship, and not otherwise.

VIII.

None fhall imbezel, fteal or take away any cables, anchors, fails, or any of the fhips furniture, or any the powder, or arms or ammunition of the fhip, upon pain of death or other punithment as the quality of the offence thall be found by a court-martial to deserve.

IX.

If any foreign fhip or veffel fhall be taken as prize, that shall Foreign fhips taken as prize not fight or make resistance, that in that cafe, none of the capnot making tains, mafters or mariners being foreigners, thall be ftripped of their clothes, or in any fort pillaged, beaten or evil intreated, upon pain, that the perfon or perfons fo offending, fhall forfeit double damages; but the faid foreign fhips, and all the goods fo taken, fhall be preferved intire, to receive judgment in the admiralty court, according to right and justice.
