CHARLES STUART, EARL of TRAQUAIR, Baron Stuart, of Traquair, and Lord Linton and Caverston, and a Baronet of Nova Scotia ; born 31 Jan. 1781; succeeded his father, Charles, late earl, 13 Oct. 1827.

THE ancestor of this noble family was James Stuart, a natural son of James, earl of Buchan, who obtained a charter of legitimation, 20 Feb. 1488-9; and m. Catharine, da. and sole heiress of Richard Rutherford, of that ilk; with her had the baronies of Rutherford and Wells, co. Roxburgh, and being killed with James IV., at the fatal battle of Flodden, 1513, left a son, William who m. Christiana, da. of John Hay, lord Yester; and by her had William, father of 4 sons; viz. 1. THOMAS HENRY DALZELL, EARL of CARNWATH, Baron Dalzell and Libberton, and a Baronet of Nova Scotia; born 2 Sept. 1797, succeeded his father, Robert-Alexander, late earl, 1 Jan. 1839; married, 9 Sept. 1834, Mary-Anne, eldest da. of the right hon. Henry Grattan, and relict of John Blachford, of Altadore, co. Wicklow, esq.

THE origin of the name of Dalzell is thus stated by Nisbet, and other Scotch genealogists. A favourite and near kinsman of king Kenneth II. having been taken prisoner by the Picts, was slain, and exposed hanging on a gibbet. The king, exceedingly grieved at this indignity, offered a great reward to any one who would undertake to recover the body; but the danger of the attempt was so imminent, that for some time no one could be found to adventure it, till the ancestor of this family came forward, and said to the king, "Dall Zell;" which, in the ancient Scottish language, signified, "I dare"; and, having successfully performed

his undertaking, took Dalzell for his surname, and a naked body suspended on a gibbet for his armorial ensigns. In his remarks on the Ragman Roll, however, Nisbet says the surname is local, and derived from the lands of Dalzell, co. Lanark.

The first of the name on record is THOMAS DE DALZELL, who was one of the Scottish barons who swore fealty to king Edward I., 1296. The present family is descended from ROBERT DE DALZELL, of Dalzell, who d. 1552, and was great-grandfather of

ROBERT DALZELL, of Dalzell, created, 18 Sept. 1628, baron Dalzell; and, in 1639

advanced to the dignity of earl of Carnwath; m. Margaret, da. of sir Robert Crichton, of Cluny, and had issue,

ROBERT, 6th earl, (great-grandson of John Dalzell, of Glenæ, 2d son of the 1st earl,) who following the example of his ancestors in their attachment to the House of Stuart, joined in the rebellion of 1715, and being taken prisoner at Preston, was impeached, and sentenced to death, but was afterwards pardoned for his life, though his titles remained forfeited till they were restored to his descendant, the late earl, in 1826. GILBERT DE OGILVY, a younger son of Gilibrede, 2d earl of Angus, assumed his surname from the lands of Ogilvy, of which, together with those of Pourin and Kyneithin, he obtained a charter from king William the Lion, and was the common ancestor of this family, of the earls of Findlater and Seafield, of the barons Banff, and of various other families of Ogilvy seated in different parts of Scotland.

Sir WALTER OGILVY, of Lintrathen, 7th in descent from Gilbert, d. 1440, leaving two sons, sir JOHN, ancestor of the earls of Airlie, and sir Walter, ancestor of the earls of Findlater and Seafield, and the lords Banff.

Sir JAMES OGILVY, son of the abovenamed sir John, was created, 28 April 1491, lord Ogilvy, of Airlie, and from him in a direct line of succession descended

JAMES, 7th lord Ogilvy, created, 2 April 1639, earl of Airlie. He was distinguished for his attachment to king Charles I., and particularly by his services at the battle of Kilsyth, for which he was excommunicated by the general assembly, and excepted out of the articles of Westminster, but afterwards pardoned. He m. Isabel, 2d da. of Thomas Hamilton, 1st earl of Haddington, and had issue, three sons, who were all engaged with their father in the service of king Charles, viz. JAMES, 2d earl; sir Thomas, slain at Inverlochy, 1645; and sir David.

JAMES, 2d earl, was taken prisoner at Philiphaugh, and sentenced to death, but escaped dressed in the clothes of his sister, and was, like his father, excepted out of the

articles of Westminster. He m., 1st, Helen, da. of George Ogilvy, 1st lord of Banff, by whom he had issue,

ALEXANDER, who on his grandfather's death, 1661, became 2d earl of Leven, and d. 1664, leaving two das., MARGARET and CATHERINE, successively countesses Leven, who both d. without issue; and, on the death of the latter of them, 1706, that title devolved on her aunt,
