THE family of Roper is of very great antiquity in the co. of Kent; its ancient seat being St. Dunstan's in Canterbury. WILLIAM DE ROSPER, or de Rubra Spatha, as the name is spelt in old dateless evidences, and Elneth, his wife, da. and heiress of Edward de Apuldore, lived in the reign of Edward III. JOHN DE RUBRA SPATHA, or ROSPER, did eminent service in Scotland under King Edward III., for which that prince rewarded him with a part of the forfeitures that were due from the Jews inhabiting London, for the violation of divers penal statutes enacted against them. EDMUND ROPER (son of Ralph Roper) was an eminent man in the reigns of Henry V. and VI., and d. 1433. His grandson,

THE family of Jerningham appears to have been seated in the counties of Norfolk and Suffolk, at a period nearly, if not quite as early, as the Conquest.

DESCENT OF THE BARONY OF STAFFORD.

Although the barony of Stafford, to which the present peer has been admitted, was created by the patent of the 12th Sept. 1640, to sir William Howard, and Mary, (sister and sole h. of Henry, lord Stafford, who d. in 1637,) his wife, yet as his lordship CLAIMS the original barony of Stafford, created by the writ of summons to Edmund de Stafford, 6th Feb., 27 Edw. I., 1299, the following account of the descent of that dignity, as well as of the various titles possessed by that illustrious house, of which the baroness Mary abovementioned was the lineal heiress and representative, cannot with propriety be omitted.

From the time of the Conquest to the reign of Edward I., Robert de Stafford and his representatives were barons by tenure; and in the 27th Edward I., Edmund, the heir of the said Robert, was, as is stated above, summoned to parliament, when, according to existing principles on the subject, the first inheritable dignity to the heirs of his body was created. His son and heir, Ralph, was in 1351 advanced to the dignity of earl of Stafford, and by his wife, Margaret, da. and sole h. of Hugh de Audley, earl of Gloucester, (by Margaret, da. and co-h. of Gilbert de Clare, earl of Gloucester and Hertford, by Joan Plantagenet, da. of king Edward I.,) had issue, Hugh, 2d earl of Stafford, K.G., from whom the earldom and barony descended in 1403 to his grandson, Humphrey Stafford, K.G., 6th earl, son and heir of Edmund, 5th earl, by ANN PLANTAGENET, da. and sole h. of THOMAS, of WOODSTOCK, duke of Gloucester, younger son of king Edward III. The said Humphrey was, on the 14 Sept. 1444, created duke of Buckingham to him and his heirs male; and in the 25th Henry VI. obtained a special grant unto himself and his heirs of precedence above all dukes in England or France excepting the blood royal; and being slain in 1460, his honours devolved on his grandson and heir, Henry Stafford, K.G., and lord high constable, who was beheaded in 1483, and was succeeded by his son and heir, Edward Stafford, duke of Buckingham, earl and baron Stafford, lord high constable and K.G. This distinguished nobleman fell a sacrifice to the tyrannical jealousy of Henry VIII., having been beheaded and attainted in 1521. Henry Stafford, his son and heir, was, by act of parliament, 1 Edward VI., restored in blood, and created lord Stafford, with limitation of the dignity to the heirs male of his body; and a question of precedency having occurred, it was decided in a committee of privileges of the lords, 12 Feb., 4 and 5 Philip and Mary, that he should rank in the precedency of the original barony. By Ursula Pole, his wife, (da. of sir Richard Pole, K.G., by MARGARET PLANTAGENET, countess of Salisbury, da. and sole h. of George, duke of Clarence, brother of Edward IV. and Richard III.,) he left issue, Henry, his son and heir, who succeeded to the dignity, and d. at Thornbury, 8 April 1566, s.p., and was succeeded by his brother and heir, Edward Stafford, who d. in 1603, left issue, (by Mary, da. of Edward, earl of Derby, by Dorothy, da. of the duke of Norfolk,) Edward, his son and

heir, who succeeded as baron Stafford. On his death, in 1625, the title devolved upon Henry Stafford, his grandson and heir, (son of Edward Stafford, his eldest son, who d. vitâ patris). Henry, lord Stafford, d. in 1637, without issue, leaving Mary, his sister, his heir, and who was also heir general of Edward, the last duke of Buckingham; but the barony, created by statute 1 Edward VI., devolved, agreeably to the limitation, upon Roger Stafford, son and heir of Richard, the youngest son of Henry the restored lord; and on his demise, about the year 1640, s.p., the heirs male of the body of Henry, lord Stafford, son of Edward, duke of Buckingham, having failed, that barony became extinct. MARY, sister of Henry, 4th lord Stafford, under that statute, and great-great-granddaughter of Henry, lord Stafford, and Ursula Pole, m. sir WILLIAM HOWARD, younger son of THOMAS, earl of ARUNDEL; and the said sir William, and Mary, his wife, were by patent, dated 12 Sept. 1640, created baron and baroness of Stafford, with remainder to the heirs male of their bodies, failing which, to the heirs of their bodies; and a grant of the same precedence as had been enjoyed by the baroness's brother, Henry, lord Stafford. But this clause having been deemed illegal, the baron was, on the 11 Nov. following, apparently with the motive of giving him as high a precedence as belonged to the original barony of 27 Edward I., 1299, (Fourth Peerage Report, pp. 50, 51,) advanced to the dignity of VISCOUNT of STAFFORD, with remainder to his heirs male. The viscount was beheaded in 1678, and being attainted, his honours were not inherited by his issue. His widow was, on the 5th Oct. 1688, created countess of Stafford for life, which title became extinct on her demise in 1693.

In the reign of James II. a bill was introduced to reverse the attainder of William, viscount Stafford, and though it was passed by the lords, and read twice and committed in the commons, yet nothing further was done on the subject. This effort having failed, the king created Henry Stafford Howard, the viscount's son and heir, earl of Stafford, with remainder, failing his issue male, to his brothers, John and Francis, and the issue male of their bodies respectively, by patent, 5 Oct. 1688, which dignity descended to John-Paul-Stafford Howard, who dying without issue in June 1762, the issue male of the persons mentioned in the patent of 1688 failed, and the earldom consequently became extinct. On this event, the representation of William Howard, viscount and baron Stafford, and of Mary Stafford, his wife, vested in the heirs of the body of MARY, sister of John-Paul, the last earl, of whom GEORGE, present lord STAFFORD, is the sole representative, and who is consequently heir of the bodies of viscount and viscountess Stafford, as well as of Edward Stafford, the last duke of Buckingham. His lordship is therefore undoubtedly heir in blood to the original barony, created by writ 27 Edw. I., and to the barony created by patent 11 Sept. 1640. The descent of both these dignities was, however, impeded by the attainder of the said duke in 1521, and of the
