AN ACT to amend chapter seven hundred and fifty-five of the laws of nineteen hundred and seven, entitled "An act constitut ing the charter of the city of Rochester," in relation to supply and distribution of water.

Became a law April 15, 1912, with the approval of the Governor. Passed, three-fifths being present.

Accepted by the City.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

amended.

Section 1. Section two hundred and seventy-three of chapter L. 1907, ch. seven hundred and fifty-five of the laws of nineteen hundred and 755,273 seven, entitled "An act constituting the charter of the city of Rochester," in relation to supply and distribution of water, is hereby amended to read as follows:

273. No person or corporation to distribute water without franchise. No person or corporation other than the city may enter upon or excavate any public street, highway or place in the city of Rochester for the purpose of laying conduits, mains or pipes for the conveyance of water, without the permission of the common council, which body may deny any such application in its discretion; and no person or corporation other than the city may furnish, sell or distribute water within the city, except under a franchise granted as provided in this act, 1provided that the city may contract with a corporation for the delivery to the city of water for the extinguishment of fires, and, when the corporation has at the time of the taking effect of this amendment a franchise to sell and distribute water in certain portions of the
