CITY OF AMSTERDAM

LOCAL LAW No. 1

A local law in relation to the police department of the city of Amsterdam, amendatory of local law number one of nineteen hundred and twenty-five. Became a law April 14, 1927, with the approval of the Mayor. Passed by the local legislative body of the city of Amsterdam.

Be it enacted by the common council of the city of Amsterdam as follows:

Section 1. The chief of police of said city shall, subject to the authority of the mayor and the commissioner of public safety, be the chief executive officer of the police department and superintend the same; he shall keep a record in a book of all cases and legal proceedings in his department and all services performed by him and by the several policemen of the city and of such fees as are chargeable by law to the county of Montgomery or to any town of said county; he shall also keep a book known as the property book in which he shall enter all articles taken from persons arrested or seized on a warrant or otherwise, together with the disposal made thereof; he shall once in each month, and oftener if required, report to the commissioner of public safety the state of the department and whether any members of the force are delinquent in their duties. The chief of police may orally or in writing suspend from duty any member of the department for neglect of duty, or, violation of the rules and regulations of the department for a period not exceeding ten days. The assistant chief of police shall discharge such duties incident to his office as may be imposed upon him by the commissioner of public safety or by the chief of police and shall, in case of the absence or inability of the chief to act, possess the power and discharge the duties of the chief of police. All policemen shall receive for their compensation a monthly salary to be fixed by the common council of said city. The police department of said city shall consist of a chief of police, assistant chief of police, three detectives, one of whom in connection with his duties as a detective, shall be in

charge of the bureau of identification of the police department, and as many patrolmen as the commissioner of public safety may determine, but not more than one for each one thousand three hundred of the population of said city as shown and determined by the last state or federal census or enumeration; but the number of such patrolmen shall not be less than the number employed when this local law takes effect. No fee or compensation other than as in this local law provided, shall be charged or received by any policeman save such reward as a policeman may be permitted to receive with the consent of the commissioner of public safety.

§ 2. Local law number one of the local laws of the city of Amsterdam for nineteen hundred and twenty-five which superseded section seventy-three of title six of chapter two hundred and forty-two of the laws of nineteen hundred and eleven, entitled "An act to amend, consolidate and revise the several acts relative to the city of Amsterdam," as amended by chapter three hundred and thirty-one of the laws of nineteen hundred and twenty-three, is hereby amended.

§ 3. This local law shall take effect immediately.

LOCAL LAW No. 2

A local law in relation to the fire department of the city of Amsterdam. Became a law April 28, 1927, with the approval of the Mayor. Passed by the local legislative body of the city of Amsterdam.

Be it enacted by the common council of the city of Amsterdam as follows:

Section 1. The fire department of the city of Amsterdam shall consist of the chief engineer, assistant enpgineer, a captain for each company in charge of a piece of fire apparatus, not exceeding seven, and such firemen as the commissioner of public safety shall with the consent of the mayor determine necessary, all of whom shall be appointed by the commissioner of public safety. The chief engineer of the fire department may, orally or in writing, suspend from duty any member of the department for neglect of duty or violation of the rules and regulations of the department for a period not exceeding ten days; and shall, subject to the powers of the mayor and of the commissioner of public safety, take and have control and management of all officers, firemen, property, measures and actions for the prevention or extinguishment of fires within the limits of said city, may call upon the chief of police or any member of the police force to assist in the protection of property, preservation of order and in the enforcement of all the rules for the government of the department. The chief engineer shall make a yearly report in writing to the commissioner of public safety, and more frequently when requested by him, showing the actual condition of the property in charge of said chief engineer, a

list of fire alarms, losses and insurance on all property destroyed since the last report, particular statements of the cause of said fires so far as known and such other information as he may deem important to the public interests. He shall make and keep an accurate inventory of all the property of the department and see that the same is not wasted, lost or destroyed and perform such other duties as required from time to time by the commissioner of public safety. The assistant engineer shall have all the power and authority of the chief engineer in case of his absence or inability to act. The captains shall be in charge of each of their respective companies, subject to the authority and supervision of their superior officers. All firemen shall receive as compensation a monthly salary to be fixed by the common council of said city. § 2. Section seventy-one of title six of chapter two hundred and forty-two of the laws of nineteen hundred and eleven, entitled "An act to amend, consolidate and revise the several acts relative to the city of Amsterdam," is hereby superseded.

§ 3. This local law shall take effect immediately.
