and do most humbly beseech Your Majesty that it may be enacted;
and be it enacted by the Queen's most Excellent Majesty, by and
with the Advice and Consent of the Lords Spiritual and Temporal,
and Commons, in this present Parliament assembled, and by the
Authority of the same, That-

I. The several Rates and Duties by the said first-recited Act
granted shall be and the same are hereby continued, and shall be
charged, raised, levied, collected, and paid unto and for the Use of
Her Majesty, Her Heirs and Successors, from and after the Fifth
Day of April One thousand eight hundred and fifty-one, for the Term 10
of Three Years thence next ensuing, and until the Assessments made
or which ought to be made for the last Year of the said Term, or
for any preceding Year, shall be completed, collected, levied, and
paid.

II. The said first-recited Act, and all and every other Act and Acts 15
in force upon or immediately before the Fifth Day of April One
thousand eight hundred and fifty-one, in relation to the Duties
granted by the said first-recited Act, shall severally be continued and
remain in full force and effect in relation to the Duties hereby con-
tinued and granted as aforesaid; and all and every the Powers, 20
Authorities, Rules, Regulations, Directions, Penalties, Forfeitures,
Clauses, Matters, and Things contained in the said Acts or any of
them, and in force as aforesaid, shall (so far as the same shall be
consistent with and shall not be superseded by the express Provisions
of this Act) severally and respectively be duly observed, practised, 25
applied, and put in execution in relation to the said Duties hereby
continued and granted, as well during the Term herein limited as
after the Expiration thereof respectively, for assessing, levying,
recovering, paying, deducting, and accounting for the said Duties and
all Arrears thereof, and for re-assessing the same in default of Pay- 30
ment, and for the suing for, adjudging, and recovering any Penalty
which shall have been or may be incurred in relation to the said
Duties, as fully and effectually to all Intents and Purposes as if the
same Powers, Authorities, Rules, Regulations, Directions, Penalties,
Forfeitures, Clauses, Matters, and Things were particularly repeated 35
and re-enacted in the Body of this Act with reference to the said
Duties hereby continued and granted as aforesaid.

III. And whereas under and by virtue of the said recited Acts the
Assessments made for the Year commencing from and after the Fifth
Day of April One thousand eight hundred and forty-eight, of the 40
Duties chargeable under the respective Schedules (A.) and (B.) of
the said first-recited Act, were continued in force for Three successive
Years,

Years, and it is expedient that the Assessments of the Duties chargeable under the same Schedules by virtue of this Act should in like Manner be in force for the Term herein-after mentioned: Be it enacted, That the Assessments to be made for the Year commencing 5 from the Fifth Day of April One thousand eight hundred and fiftyone, of the several Duties chargeable under the said respective Schedules (A.) and (B.), by virtue of this Act, shall respectively be and remain in force for Three successive Years, under and subject to the same Rules, Regulations, and Conditions as are specified in the 10 said first-recited Act with reference to the Assessments made under the same Schedules for the Period of Three Years in the said firstrecited Act mentioned: Provided always, that the respective Commissioners acting in the Execution of the said Acts shall cause fresh Duplicates of the said Assessments to be made out for the Second 15 and Third Years respectively of the said Term for which the said Duties are continued by this Act, and such Duplicates to be delivered, together with Warrants under their Hands and Seals, to the Collectors to be appointed for collecting and levying the said Duties for the said Second and Third Years respectively, anything in the said first20 recited Act contained to the contrary notwithstanding.

IV. And whereas Contracts for Compositions for the Duties Power to chargeable under Schedule (D.) of the said first-recited Act have compound been entered into, pursuant to the Powers given by the said recited under ScheAct in that Behalf, for a Term expiring with the Fifth Day of April dule (D.) 25 One thousand eight hundred and fifty-one, and it is expedient to renew and continue the Powers of the Commissioners to enter into new Contracts for such Compositions for the Term limited by this Act: Be it enacted, That it shall be lawful for the Commissioners for special Purposes in the said first-recited Act mentioned to 30 contract and agree for a Composition for the Duties chargeable under the said last-mentioned Schedule by virtue of this Act with any Person who may be desirous of compounding for the same for the Period of Three Years, to commence from the Fifth Day of April One thousand eight hundred and fifty-one, under and subject 35 to the Rules, Regulations, and Conditions specified in the said firstrecited Act with reference to the Compositions thereby authorized to be made for the Duties chargeable under the same Schedule for the Term in the said first-recited Act mentioned.

ARRANGEMENT OF CLAUSES.

Preamble recites 9 G. 4. c. 58.

Recited Act repealed in so far as may be necessary to give effect to present Act; Sect. 1.

Justices in Quarter Sessions to appoint a General Committec in each County, by whom the maximum Number of Public Houses is to be fixed; 2.

Where the Number of Public Houses already existing is greater than the Number so fixed, no new Certificate to be granted until the Number is less than such Maximum; 3.

Extra Certificates may be granted on special Cause shown; 4.

Maximum Number to remain as fixed; how such Maximum may be afterwards altered; 5.

Limitation of Power of Justices to grant Certificates; 6.

General Committee, when appointed, to exercise the Powers of
Justices in reference to dividing Counties into Districts, and
empowered to alter the Day for granting Certificates; 7.
Appeal from Justices to the General Committee; 8.

General Committee to be re-appointed triennially; Vacancies by
Death, &c. to be filled up; 9.

No Certificate to be granted until Premises have been inspected; and unless with a Condition that no Groceries be sold on the Premises; 10, 11.

Grocers may obtain Certificates for the Sale of Porter, Spirits, &c. by Retail; 12.

Repeal of Sect. 14. of 6 G. 4. c. 81. so far as regards Scotland; 13. Certificate to be granted under 9 G. 4. c. 58. to contain Conditions that no Porter, &c. shall be sold by Retail on the Premises; and no one Certificate shall be issued enabling Persons to sell Porter &c. and Spirits, &c.; 14.

Excise Licences not to be granted without or contrary to a Certificate obtained under this Act; 15.

Duties granted on certain Licences to retail Foreign Wine in

Scotland; 16.
