JURISPRUDENCE.

Candidates should answer SEVEN questions only.

1. Distinguish, and give illustrations of Right, Liberty, Power. Can we speak with propriety of the right of a prisoner to be kept in safe custody?

2. Distinguish Absolute and Relative, General and Particular Duties.

3. What is meant by the " Public Law of Victoria"? What is the importance of the distinction between Public and Private Law in England or Victoria as compared with (a) France; (b) the United States?

4. In what senses are the terms constitutional and unconstitutional used?

5. What are the principal sources of Obligation?

6. What is the nature of Status? Consider how far the term status may be applied in the case of the following persons:-A minister of religion; a member of Parliament; a married woman; a stockbroker; a trustee?

7. With what different meanings is the term Malice used in the law?

8. What is a juristic person? Give an account of the different juristic persons met with in modern English law.

9. It is provided that a person breaking certain laws shall be liable respectively to (a) exemplary damages recoverable in an action by any person injured; (b) a mulct recoverable by any member of the public; (c) fine or imprisonment upon the prosecution of the Attorney-General. Consider how far the term penal law is applicable in each of the cases.

10. What are the essential features which distinguish judiciary from statute law?

1. What are the essential features of aequitas? In what senses is the term jus gentium used?

2. What in your opinion is the scope of the Jus quod ad personas pertinet?

3. Write a short note on the status of married women, and state the leading features of the relations of husband and wife in regard to each other's property.

4. Describe the different modes of ownership.

5. What are the principal incidents of the praedial servitude, and wherein does a servitude differ from a mere contractual obligation?

6. Write an account of the development of the testamentum tripertitum.

7. What were the principal limitations upon the testamentary power?

8. A, a Roman citizen, dies intestate, leaving B, a son, in power; C, an emancipated son; D, a son given in adoption; and E, an adopted son. Consider their rights under a Praetorian succession when the estate is offered to (a) liberi, (b) agnati, (c) cognati.

9. What general principles are to be gathered from the Law of Contracts?

10. What are the characteristics of the formulary procedure, and wherein lay the value of that procedure?

CONSTITUTIONAL HISTORY AND LAW.

1. What is the difference in the constitution of Parliament and the. Three Estates of the Realm ? Account for the number of the estates.

2. Distinguish between Peers and Lords of Parlia

ment.

What are the principal legal and constitutional questions that have arisen as to the prerogative of creation?

3. Are there, in your opinion, any and what differences in the Cabinet System as it exists in England and as it exists in Victoria?

4. Write a short history of judicial tenure. What, if any, are the limitations upon the power of the Crown to appoint judges.

5. What is the character of the rules governing the relations of the Lords and Commons in regard to

Money Bills"? Consider whether an Act of

the Victorian Parliament appropriating revenue can be called in question in the Courts on the ground of failure to observe the forms prescribed by the Constitution Act.

6. Consider, historically, the position of the Privy Council in relation to the Colonies. How does the Commonwealth Bill deal with appeals to the Queen in Council?

7. What is a self-governing colony? Are there any and what institutions of government in Victoria which stand outside the system of self-government and are under direct Imperial control?

8. What is meant by a bureaucracy? Consider the application of that term to the government of England, France, and Victoria.

9. On what occasions and in what ways have attempts been made in Victoria to raise and expend money without the assent of Parliament?

10. Consider our system of ministerial government as supplying a link between Parliament and the administrative departments.
