And, for the more effectually preventing any frauds or judged to serve abuses that may be practifed in the discharging of fuch persons, his Majefty oy be it further enacted by the authority aforefaid, That no perfon virtue of this who fhall be ordered and adjudged to ferve his Majefty as folact, (unless dier or as a failor, by virtue of this act, and fhall have been apaccident, &c.) proved of as aforefaid, fhall, on any account, during the term. of five years, unless disabled within that time by unavoidable accident or bodily infirmity, be difcharged from his Majesty's fervice; and any officer of his Majefty's land forces, marines, or fea fervice, who fhall prefume, knowingly and wilfully, to dif charge any perfon fo raifed, levied, and delivered over, as aforefaid, contrary to this act, or fhall, by falfe mufer or certificate, or in confideration of a gratuity of any kind, or by any other collufive or evafive ways or means whatsoever, fuffer or permit any fuch perfon to avoid the actual fervice hereby intended, every fuch officer fhall, for fuch offence, be cashiered.

XIX. transfer of any tea, coffee, cocoa-nuts, whilft the fame fhall remain in the refpective warehouses wherein the fame fhall be lodged and put, according to the directions of an act, made in the tenth year of the reign of his late Majefty king George the first; nor by reason of any purchase of any tea, coffee, or cocoanuts, or chocolate, at any fale or fales made by the direction of the East India company, or of the commiffioners of customs or excise respectively; or at any fale made of any tea, coffee, or cocoa-nuts, fold for the benefit of the infurers or proprietors thereof, and which may be fold free of duty to defray the charges of falvage; nor by reafon of any firft purchase of any prize teas: nor fhall any fuch dealer in foreign fpirituous liquors be fubject in foreign fpirituous lito the faid penalty of one hundred pounds by reafon of the purquors, fhall be chafe of any foreign fpirituous liquors, whilft the fame remain on fubject to the board the ships in which the fame were lawfully imported, or faid penalty of on the quays upon which they fhall have been lawfully landed; 100! nor to the purchase of any rum whilft the fame remains in any warehouse wherein the fame fhall have been put, according to the directions of the act of the fifteenth and fixteenth years of the reign of his late majefty King George the fecond; nor to the purchase of any arrack whilft the fame remains in the warehouses of the united company of merchants of England trading to the East Indies; nor to the purchase of any prize foreign fpirituous liquors; nor to the purchafe of any foreign fpirituous liquors fold for the benefit of the infurers or proprietors thereof, and which may be fold free of duty to defray the charges of falvage; any thing herein-before contained to the contrary notwithftanding.

XXI. And be it further enacted by the authority aforesaid, That if, at any time after the faid first day of August, one thoufand feven hundred and feventy-nine, any perfon or perfons what foever, other than fuch as thall have duly made entry, at the proper offices of excife, of the places by them refpectively made use of for keeping of coffee, tea, cocoa-nuts, or chocolate, or for the keeping of foreign brandy, or foreign fpirituous liquors, fhall paint or write, or caufe to be painted or written, over the door or in the front of any place to them refpectively belonging, the words dealer in coffee, tea, cocoa-nuts, or chocolate, as the cafe fhall be, or the words importer of, or dealer in fpirituous liquors every person and perfons refpectively offending therein, fhall forfeit and lofe the fum of fifty pounds, and shall also be fubject to the several penalties and forfeitures to which perfons felling of, or dealing in, coffee, tea, cocoa-nuts, chocolate, or foreign fpirituous liquors, without entry, are now fubject unto.

XXIII. And whereas by an act, made in the nineteenth year of penalties for the reign of his late majesty King George the Second, intituled, An his own efact for the further punishment of perfons going armed or dif- fence. guised in defiance of the laws of customs or excife; and for in- Recital of an demnifying offenders against thofe laws upon the terms in this act 19 Geo. 5, act mentioned; and for the relief of officers of the cuftoms in informations upon feizures; and which faid act was to continue in force for the space of feven years, and from thence to the end of the next feffion of parliament; and which, by feveral fubfequent ftatutes, of the twenty-fixth and thirty-fecond years of the reign of his faid late Majesty, and the fourth, eleventh, and eighteenth years of the reign of his prefent Majefty, was further continued until the twenty-ninth day of September, one thousand feven hundred and eighty-five, and from thence to the end of the then next feffion of parliament ; perfons charged with being guilty of offences in the faid act mentioned and prefcribed, were required to furrender themfelves within a time limited by the faid act, and that on neglect or refusal of surrender, Such perfons were to be adjudged, deemed, and taken to be convicted and attainted of felony: and whereas doubts have arifen whether the methods and orders in the faid act directed and prescribed, relative to the apprehending and harbouring the offenders therein mentioned, or for caufing fuch offenders to furrender, are or were re-enacted and continued by the faid feveral acts: now, to put an end to fuch doubts, be it enacted and declared by the authority aforesaid, All the rules, That all and every the methods, orders, directions, rules, pro- penalties, and clamations, penalties, punishments, rewards, matters, and rewards, in things, provided, ordered, fettled, directed, impofed, given and the recited act required, by the faid act of the nineteenth year of the reign of his contained, refaid late majefty, relative to the furrender, proclaiming, appre- furrender, and hending, harbouring, and punishing fuch offenders, was, were, harbouring, and are continued and re-enacted by the faid feveral acts, made &c. of the of in fenders there.

XXIV. And it is hereby further enacted by the authority aforefaid, That all foreign thread lace which, from and after imported after the first day of August, one thousand feven hundred and feventyAug. 1, 1779, nine fhall be imported into this kingdom, fhall, after the fame at each end of hath been entered at the custom-houfe, and before it shall be every piece. difcharged by the officers, and delivered into the cuftody of the importer, or his agent, be marked or sealed at each end of every piece, with fuch mark or feal, and by fuch officer or officers, as the refpective commiffioners of the customs in Great Britain fhall direct and appoint for that purpose.

All perfons XXV. And it is hereby further enacted by the authority aforepoffeffed of fo- faid, That if any perfon or perfons, having in his, her, or their reign thread custody or poffeffion, in any part of this kingdom, for fale, and lace may, on or before Feb. any foreign thread lace fo directed to be marked or fealed as 1, 1780, bring aforefaid, fhall, on or before the first day of February, one thousand seven hundred and eighty, bring or cause such lace to be brought to the custom-house for the port nearest to the place where fuch lace fhall be, and fhall make proof on oath before the collector and comptroller, or other principal officer of the cuftoms at fuch port, (which oath fuch collector and comptroller, or other officer, is and are hereby required to adminifter without fee or reward), that the legal duties due and payable to his Majefty were paid upon the importation of fuch lace, if the fame was imported by him, her, or them, or that fuch lace was purchafed by fuch perfon or perfons (having poffeffion thereof) in a legal fair way of trade, and that he, she, or they, verily believe the legal duties due and payable to his Majesty have been duly paid for the fame, mentioning the time when, and the port where, fuch lace was imported, or the time when, and of whom, fuch lace was purchafed, as the cafe may be, fuch lace fhall be thereupon, without fee or reward, inarked or fealed at each end of every piece with fuch mark or feal, and by fuch officer or officers, as the refpective commiffioners of the cuftoms in Great Britain, or any three or more of them, shall direct and appoint for that purpose.

XXVI. And be it further enacted by the authority aforefaid, That, from and after the said first day of August, one thousand feven hundred and feventy-nine, every perfon intending to export any fuch foreign thread lace which fhall have been marked or fealed pursuant to the directions of this act, fhall, before fuch lace is shipped in order to be exported, give notice to the proper officer or officers, to be appointed for that purpose by the respective commiffioners of the customs in Great Britain, when and where he will pack up the fame in order to be exported;
