Owners of goods, or perfons delivering any on their behalf, shall give bills of lading to the steersmen, who are to fame to the collectors of the tolls. jesty, as requires perfons having the charge of any boat, barge, lighter, or other veffel, to give an account in writing, as therein is mentioned, of the quantity, quality, and weight, of the goods, wares, merchandizes, aud commodities, which thall be in fuch boat, barge, lighter, or other veffel, and also of the quantity, quality, and weight, of the goods, wares, merchandizes, and commodities, which fhall have been discharged or taken out of fuch boat, barge, lighter, or other veffel, before the arrival thereof at the place where fuch account is to be given, and as inflicts any penalty on fuch perfons for not giving fuch account, or for giving a falfe account, fhall be, and is hereby repealed. VIII. Provided nevertheless, and be it further enacted by the authority aforefaid, That, from and after the twenty-ninth day of September, one thousand seven hundred and feventy-nine, the owners of, or perfons felling any goods, wares, or merchandize, or any person who fhall deliver any goods, wares, or merchandize, on account of fuch owners or perfons felling the fame, on board any boat, barge, lighter, or other veffel, to be carried or produce the conveyed upon the faid river, cuts, or canals, fall, and are hereby required to give a true account, in writing under their refpective hands, of the quantity, quality, and weight, of all fuch goods, wares, and merchandize, to the fteerfman or other perfon having the care, charge, or management of the boat, barge, lighter, or other veffel, on board of which fuch goods, wares, or merchandize shall be delivered, together with the date of the delivery thereof; and the faid fteerfman or other perfon fhall produce the faid account to the collector or collectors of the said rates or duties, and deliver a true copy thereof to every such collector; and in cafe any fuch steerfman or other perfon fhall not produce fuch account, and deliver a copy thereof as aforefaid, every such steersman or other perfon fhall forfeit and pay the fum of ten pounds; and in case any such steersman or other perfon fhall produce a false account to any fuch collector or collectors as aforefaid, the person who shall have figned fuch falfe account fhall forfeit and pay the fum of five pounds. And, for the better enabling the collectors of the faid rates or duties to judge of the truth of the accounts of lading to be produced as aforefaid; be it enacted by the authority aforefaid, That, denoting their from and after the first day of January, one thoufand feven hundred and eighty, all boats, barges, lighters, and other veffels, which fhall be navigated upon the faid river, cuts, or canals, fhall be painted or marked, in three different places on each fide thereof, with graduated figures or marks, of proper dimensions, at fuch distances, and upon fuch parts of the boat, barge, lighter, or other veffel, as the faid trustees, or any five or more of them, shall order, under the direction of fome proper and skilful perfon; and fo from time to time, as occafion fhall require; and the fame fhall at all times be kept fo marked, in a plain and legible manner; and that, after the faid first day of January, one thousand seven hundred and eighty, if any boat, barge, lighter, or other veffel, fhall be navigated upon the faid river, cuts, cuts, or canals, not being painted or marked in a plain and legi- act as directs X. And be it further enacted, That the faid truftees, or any First meeting five or more of them, fhall hold a meeting for carrying the pur- of the trustees. poses of the faid recited acts, and this act, into execution, at the fign of the Rofe and Crown, at Enfield Highway, in the parish of Enfield, in the faid county of Middlefex, upon the Monday fevennight after the paffing this act, and may adjourn fuch meeting from time to time, previous to their first general meeting, (to be holden as herein-after mentioned,) as they fhall think proper; and that the faid trustees, or any five or more of them, Three genefhall hold three general meetings in every year, at or within ral meetings the refpective times and places herein-after mentioned; (that is to be held in to fay) in the town of Hertford, upon the laft Monday in July, or within fix days afterwards; in the parish of Waltham Holy Cross, in the faid county of Effex, on the last Monday in October, or within fix days afterwards; and in the city of London, on the laft Monday in January, or within fix days afterwards; and the faid trustees, or any five or more of them, fhall, at fuch refpective general meetings, appoint the day, and the house or place (being within the refpective times, and at the respective places, aforefaid) upon and at which their then next general meet- at which they ing fhall be holden; and the clerk to the faid trustees for the shall audit and time being fhall, at fuch respective general meetings, lay before the trustees then affembled, a full state of the accounts relative caufe an abto the excution of the said recited acts, and this act, up to such stract thereof of the days following, videlicet, Midsummer-day, Michaelmas-day, to be made, and Christmas day, as fhall happen next before the day of hold- and entered ing fuch refpective meetings, in order that the fame may be au- their proceeddited and fettled; and the faid trustees, at fuch general meetings, ings. are hereby required to examine and pafs the faid accounts; and after the same shall be examined and passed, an abstract thereof fhall be made out, and figned by five or more of the faid trustees, and the fame fhall be fairly entered in the book of proceedings of the faid trustees; and all perfons interested in the faid navigation may, at all convenient times, have a copy of fuch abstract, upon paying to the clerk to the faid trustees the fum of two fhillings and fixpence, and in cafe the said trustees shall not fettle and pafs the faid accounts at any fuch general meeting, fettle the accounts, and in the book of After 2 years, the trustees fhall fettle the accounts at two several meetings in every year. Trustees impowered to pay off any principal money now due; giving three months notice, Provifo. meeting, then fuch meeting fhall be adjourned to the feventh day then next following, and fo from time to time, until the faid accounts shall be fettled and paffed, and an abstract thereof made and figned as aforefaid; and after the faid accounts fhall be completed as aforefaid, the faid truftees may adjourn fuch respective meetings to fuch place and time, previous to the time of holding their next general meeting, as the faid trustees, or any five or more of them, shall think proper. XII. Provided nevertheless, that after the expiration of two years from the paffing of this act, the said trustees fhall be obliged to examine and fettle the faid accounts at two at least of the faid three general meetings in every year, any thing hereinbefore contained to the contrary hereof notwithstanding. XIII. Provided alfo, That no money fhall be borrowed by the faid trustees, until the said accounts shall have been settled, and entered as aforefaid. XIV. And whereas doubts may arife touching the validity of fome of the fecurities granted by the faid trustees; to obviate fuch doubts, and to fecure the feveral creditors who have, bona fide, lent and advanced their money for the purposes of the faid navigation; be it enacted by the authority aforefaid, That the feveral principal fums of money fo lent and advanced to the faid trustees, and the annuities granted by them, fhall be, and they are hereby refpectively declared to be charged upon the rates or duties granted and made payable by the faid recited act of the feventh year of the reign of his prefent Majefty, and alfo upon the rates or duties by this act granted and made payable; and that the feveral fecurities given and granted for the payment thereof, are hereby declared to be valid and effectual in the law, to all intents and purposes. XV. And whereas doubts have arifen touching the power of the faid trustees to pay off any particular fecurities for money at interest already granted, in cafe they find it neceffary fo to do; be it therefore enacted and declared by the authority aforefaid, That it fhall and may be lawful for the faid trustees, or any seven or more of them, from time to time, as they fhall think proper, to pay off any of the principal money borrowed and due upon the credit of the said rates and duties; provided three calendar months notice thereof, at the leaft, fhall be given in writing, figned by them, to the perfon or perfons entitled to the money fo to be paid off, and of the day and place at and upon which fuch money will be paid; and in cafe the fecurities given for fuch money shall not be produced at the time and place to be mentioned in fuch notice, and, upon tender of the principal money, and all interest then due thereon, fhall not be delivered up to the faid trustees, or to their clerk, that then the intereft of all fuch principal money shall from thenceforth cease, and be no longer paid or payable. XVI. Provided nevertheless, That the principal money in respect whereof fuch notice fhall be given, and alfo the intereft for the fame up to the time mentioned in fuch notice for the pay ment ment thereof, shall still remain due and payable, until the fame shall be received by the perfon entitled to the fame. former acts, XVII. And be it further enacted, That no money fhall here- No money to after be borrowed upon the credit of the rates and duties autho- be hereafter rised to be collected on the faid river, or any of them, unlefs borrowed, untwenty-one trustees at the least shall be prefent, and shall concur therein, and unless seven of such trustees fhall be refident in the faid county of Hertford, feven within the faid county of Effex, and feven within the faid county of Middlefex and city of London, or one of them; and that no fuch money fhall be fo borrowed, but at a meeting to be holden for that purpose; of which meeting one calendar month's notice at the leaft thall be given in fome of the publick newspapers circulated in the faid counties, at least three times before the borrowing any fuch money; any thing in the faid recited act of the feventh year of the reign of his prefent Majefty to the contrary hereof notwithstanding. XX. Provided nevertheless, and it is hereby declared, That and then not no more than the fum of twenty thousand pounds, over and more than above the faid fum of forty-four thoufand three hundred pounds, 20,000l. principal money, already charged on the faid rates, fhall hereafter be borrowed on the credit of the faid former act, or this prefent act; any thing in the faid former act, or this act, to the contrary hereof notwithstanding. rates for pay XXI. And, in order to prevent any waste of water at any of the locks, at or near the places appointed for collecting the faid rates or duties, and for the better collection thereof; be it enacted by the authority aforefaid, That the collectors of the faid rates or duties shall, and are hereby authorized and required, at all times hereafter, to keep the gates of the locks, at or near the several veffel to pafs places appointed for collecting the faid rates or duties, properly hut and locked, or otherwife fastened, so as not to suffer any unnecessary wafte of water through the fame, (except only at fuch times, and for fo long as fhall be neceffary for boats, barges, lighters, and other veffels, to pafs through fuch locks, and in times of flood;) and no boat, barge, lighter, or other veffel, shall be suffered to pass through any such lock until the whole rates or duties authorised to be collected fhall be paid to fuch collector; and in cafe any collector fhall not keep the gates of the lock, at or near the place where he fhall be appointed to collect the faid rates or duties, properly fhut and locked, or otherwise fastened, fo as not to fuffer any unneceffary wafte of water through the fame, or if fuch collector fhall permit or suffer any boat, barge, or lighter, or other veffel, to pafs through any fuch lock as aforefaid, before the full rates or duties which ought to be collected fhall have been paid, every fuch collector offending in either of the cafes aforefaid fhall, for every offence, forfeit and pay any fum not exceeding forty fhillings. And, for the more effectual preventing the waste of water in any of the faid cuts or canals, to the prejudice of any mill, be it further enacted and declared by the authority aforefaid, That in pair, to pre. cafe any of the locks or other works made or erected, or to be made or erected, by the faid trustees, shall be out of repair, and any mill fhall be prejudiced thereby, then, and in every fuch. cafe, upon notice thereof in writing, given by the occupier of fuch mill to the furveyor to the faid trustees, fuch furveyor is hereby required forthwith to infpect into and confider the fame, and report such notice, and his opinion thereof, to the faid trustees, at their next meeting; and the faid truftees, or any five or more of them, fhall, and are hereby required, at their faid next meeting, to take the fame into confideration, and as soon as may be to caufe fuch locks and works to be put into good and sufficient repair, so as to prevent the wafte of water as aforefaid; and in cafe fuch furveyor fhall refufe or neglect to infpect into and survey fuch defect or want of repair in any of the faid locks or other works, or make fuch report as aforefaid, he fhall forfeit and pay any fum not exceeding ten pounds nor less than forty fhillings.
