When ftarch officer fuch account, in writing, diftinguishing therein as aforefaid; or if, after fuch account given in as aforefaid, any officer of excife shall discover, in any place whatsoever, entered or not entered, any increase in the number of pieces, or a greater number of the large or midling pieces than were particularly specified in fuch writing, then, and in every fuch cafe, every fuch maker and makers of ftarch fhall, for each offence, forfeit and lose the sum of two hundred pounds. XIV. And, that fuch officers of excife may, without inconvenience or hurt, be able to count the faid pieces in fuch stove or ftoves, it is hereby enacted, That, from and after the faid fifth day of July, one thousand seven hundred and feventy-nine, every maker of ftarch fhall provide proper ladders, and fhall affift the faid officers in taking an account of the said several pieces of ftarch in fuch ftove or ftoves; and that no maker or makers of ftarch fhall, by himself, or by any other perfon, during the space of two hours after such officer (hall have entered the flove of any fuch ftarch-maker, for the purpose of counting the number of pieces of ftarch then in fuch ftove, ftir or break up the fire under the faid ftove, nor fhall, during the said space of two hours, whilft fuch officer remains in fuch stove, throw, or cause to be thrown, upon the pan of fuch ftove, any dirt, meal, or other ingredient, whereby a fmoak may be raised, or the officer hindered or obstructed in counting on forfeiture the pieces of ftarch in the faid ftove and if any fuch maker or of 2001. And be it further enacted by the authority aforesaid, That, from and after the faid fifth day of July, one thoufand feven hundred and feventy-nine, if any maker of starch fhall fraudulently hide or conceal, or fhall caufe or fuffer to be hid or concealed, any ftarch, to the intent to deceive his Majefty of the juft duties chargeable on the fame, that then, and in every fuch case, the party fo offending.fhall forfeit and lose the fum of one hundred pounds; any law, cuftom, or ufage, notwithftanding. XXI. And be it further enacted by the authority aforefaid, That, from and after the faid fifth day of July one thoufand feven hundred and feventy-nine, if any maker of ftarch shall obstruct or hinder any of the officers for the duties upon ftarch, in the execution of any of the powers and authorities given to him or them by this or any other act, for the afcertaining and fecuring the duties upon ftarch, the perfon or perfons offending therein fhall, for every fuch offence, forfeit and lose the sum of fifty pounds. XXII. And be it further enacted by the authority aforefaid, That all fines, penalties, and forfeitures, impofed by this act, fhall be fued for, recovered, levied, or mitigated, by fuch ways, means, and methods, as any fine, penalty, or forfeiture, is or may be fued for, recovered or mitigated, by any law or laws of excife; or by action of debt, bill, plaint, or information, in any of his Majesty's courts of record at Westminster, or in the court of exchequer in Scotland, refpectively; and that one moiety of every such fine, penalty, or forfeiture, fhall be to his Majesty, his heirs and fucceffors, and the other moiety to him or them who fhall discover, inform, or fue for the fame. XXIII. And be it further enacted by the authority aforefaid, That if any perfon or perfons fhall, at any time or times, be fued, molefted, or profecuted, for any thing by him or them done in pursuance or by colour of this act, or of any matter or General issue. thing in this act contained, fuch perfon and perfons fhall and may plead the general iffue, and give this act, and the fpecial matter, in evidence in his or their defence; and if afterwards a verdict shall pass for the defendant or defendants, or the plaintiff or plaintiffs fhall become nonfuited, or discontinue his, her, or their action or profecution, or judgement fhall be given against him, her, or them, upon demurrer or otherwife, than fuch defendants hall have treble costs awarded to him or them against fuch plaintiff or plaintiffs.
