An act for fettling and fecuring a certain annuity on the earl of Chatham, and the heirs of the body of the late William Pitt, earl of Chatham, to whom the earldom of Chatham fhall defcend, in confideration of the eminent fervices performed by the faid late earl to his Majesty and the publick.

WH

HEREAS we, your Majesty's most dutiful and loyal commons, did unanimously address ourselves to your Majesty, humbly to beseech your Majefly that you would be graciously pleased to beftow fome fignal and lafting mark of your royal favour, on the family of the late William Pitt earl of Chatham, and to affure your Majefty, that whatever, from your princely goodness, your Majefty Should think proper. to be granted, this houfe, animated by the gratitude which they, in common with the rest of your Majesty's fubjects, feel towards the memory of that upright and difinterefled minifter, and ambitious of giving a teftimony of their approbation to that publick virtue and fpirited conduct which directed the councils of this country in the laf glorious and fuccessful war, would, with the greatest chearfulness, make good to your Majefty; to which addrefs, your Majefty was pleafed to return this most gracious anfwer; That your Majesty would take the fame into your confideration, and that you would do therein what should appear to your Majesty to be most proper, agreeable to the defire of your faithful commons; and alfo, by your Majesty's most gracious message, to declare, that your Majefly being, defirous to comply, as speedily as poffible, with the faid request of your faithful commons, haa given directions for the granting to the prefent earl of Chatham, and to the heirs of the body of the late William Pitt, to whom the earldom of Chatham fhall defcend, an annuity of four thoujand pounds per annum, cut of the civil list revenue; but that Majefty, not having it in your power to extend the effects of the faid grant beyond the term of your Majesty's life, recommended it to the boufe to confider of a proper method of extending, fecuring, and annexing the fame to the earldom of Chatham, in fuch manner as should be thought most effectual for the benefit of the family of the faid WilJiam Pitt earl of Chatham: we, your Majefty's most dutiful and loyal fubjects, the commons of Great Britain, in parliament asfembled, duly confidering your Majefty's moft gracious intention, do most humbly befeech your Majefty that it may be enacted; and be it enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That in lieu of the faid annuity of four shousand pounds per annum, fo directed to be granted to the prefent earl of Chatham, and to the heirs of the body of the late William Pitt, to whom the earldom of Chatham thall defund, to John fcend, as aforefaid, one annuity, or yearly rent or fum of four

II. III. IV. And it is hereby further enacted by the authority aforesaid, That, after figning of fuch warrant, the fame thall be good, valid, and effectual in law, according to the purport and true meaning thereof, and of this act; and fhall not be determinable or revocable by or upon the demife of his Majesty, (whom God long preferve), or of any of his heirs or fucceffors, or by or upon the death or removal of any of the faid commiffioners of the treasury, or the lord high treasurer, or by or upon the determination of the power, office, or offices, of them, or any of them. V. And be it further enacted by the authority aforefaid, That the commiffioners of the treafury now being, and the high treafurer of the treafury for the time being, chancellor and undertreasurer, chamberlains and barons of the exchequer, and alf other the officers and ministers of the court of exchequer, and of the receipt thereof, now and for the time being, fhall, and they are hereby authorifed and ftrictly enjoined and required to do, without fee or reward, all fuch acts, matters and things, as are herein-before directed and required, or shall be neceffary to be done and performed by them, or any or either of them, in order to render this act, and the feveral payments hereby directed, effectual.

and adminiftrators, by bill, plaint, or action of debt, and fhall or may recover judgements, and fue out executions thereupon, against fuch officers refpectively, their heirs, executors, or administrators, for fo much of fuch fum or fums of money then due and owing upon the faid annuity, yearly rent, or fum, or any part thereof, as fhall have been in the hands of the officer or officers of the receipt of the exchequer, at the time or times when demands fhall have been legally made of the payment of the said annuity, yearly rent, or fum, or any part thereof, as aforefaid, or for the refufal or neglect to do any act neceffary to be done by fuch officer or officers refpectively.

VII. CA P. LXVI.

An act for making proper drains and fewers, for the purpose of carrying off the water from the prebendal estate of Halliwell and Finfbury, in the fuburbs of the city of London; and for other purposes therein mentioned.

Preamble. Recital of act 9 Geo. 3. and an indenture dated May 30, 1769.
Mayor, &c. impowered to make a new fewer; and to appoint commiffion-
ers. Commiffioners to confit of the commiffioners under the act 11 Geo.3.
Mayor, &c. may appoint officers. Part of the new fewer to be under the
management of the commiffioners, &c. for Holborn and Finfbury divi-
fions. Power for digging for materials, &c. Preamble, reciting that great
benefits will accrue to certain parts of the county of Middlefex, from the
new intended fewer: in confideration of which, the court of fewers for
the faid parts are to pay 1501. per annum, into the chamber of London,
by half yearly payments. Certain parts of the new fewer to be completed
by June 24, 1779. The faid yearly fum of 150l. to be placed to the

payment, how the fame fhall be recovered. Commiflioners of fewers to
make an equal pound rate for raifing faid 150l. per annum, &c. within
certain limits of the county of Middlesex, according to the yearly rent of
the premises to be rated. In default of payment of faid 150l. per annum,
mayor, &c. impowered to make a pound rate for the deficiency. All te-
nants, &c. to pay rates, whether rated or not. Directions for affeffing

houses let out in lodgings, &c. Rates for houses, &c. untenanted, to be paid by owners, or future occupiers. Dead walls, meeting-houses, &c. to be affeffed. Who fhall pay fuch affeffments. How they may be recovered. Rates fhall be paid by owners of premifes. This act not to impeach any agreement between landlord and tenant. Court of fewers impowered to compound for rates to be made by them, &c. Court of fewers may alter rates within certain limits. Collectors to be appointed by the court of fewers. Court of fewers impowered to pay debts. Common council, or commiffioners, may appoint collectors, who are to pay the money into the chamber of London. Collectors refusing to account, fhall be committed. Court of fewers may make additional allowance to their clerk, &c. Collectors, &c. may examine books relating to the poor's rates. Veftry clerk, &c. to give them copies thereof, on paying 2 d. for every 72 names, &c. Penalty on neglect or refufal for ten days. Court of fewers impowered to make new fewers, &c. within the limits of Finsbury, &c. The court of fewers may communicate the fewers within Finsbury, &c. with the new fewer in the prebendal estate, and the fewers in the city of London; but not to exceed in width or depth, the head of the fewer with which the fame fhall communicate, &c. The furveyor of the commiffioners under the act of 11 Geo. 3. impowered to stop up fuch, fewers, &c. fo communicating. Penalty on perfons unftopping fuch fewers, &c. Surveyor to infpect fewers, &c. Penalty on perfons interrupting commiffioners, workmen, &c. in executing this act. Penalties how to be difpofed of. Preamble, reciting part of the act 11 Geo. 3, relating to the affeffments. The commiffioners under the act 11 Geo. 3. impowered to apply a competent part of the fewer rates directed to be raised by the fame act, in aid of the other rates, &c. Court of fewers impowered to alter the position of pipes, &c. Owners of private drains to cleanse the fame. Penalty on neglect thereof Property of the fewers, &c. vefted in the commiffioners of fewers for Holbourn and Finsbury divifions. Vacant ground lying open, or roads out of repair, &c. to be inclosed and amended. If owners, &c. neglect, commiffioners to complete the fame, and to be reimburfed by the parties neglecting. This act to commence at the time of holding the next court of fewers for Holbourn and Finfbury divifions. Fines, forfeitures, and rates, how to be recovered and applied. Warrants to be iffued by the court of fewers, to be according to the form annexed. Charges of diftrefs to be levied by the perfons making the fame. Clerk, &c. to fummon the court of fewers when neceffary. Court of fewers, in the name of their clerk, &c. may bring actions for penalties against this act, or for the rates, &c. How plaintiff to proceed in fuch actions. Court of fewers may adminifter an oath, &c. Diftrefs not to be deemed unlawful for want of form. Plaintiff not to recover if tender of amends be made. Proceedings not to be quashed for want of form. Orders of the court of fewers to be evidence. Laws relating to fewers to be in force in Holbourn and Finsbury divisions, &c. except in the cafes before mentioned. Persons aggrieved may appeal to the quarter feffions. Limitation of actions. General iffue. Treble cofts. This act not to extend to fewers, &c. within the liberties of the tower hamlets, &c. Commiffioners impowered to fet up bars, pofts, &c. fcr the lafity of foot paffengers. CA P. LXVII.

An act for authorifing the juftices of the peace for the county of Middlefex to fell the prefent feffion-house for the faid county, and for enabling them to build another feffion-house in a more convenient fituation, and to keep the fame in repair; and for applying the fum of eleven thou fand pounds (to be borrowed upon the credit of the furpluffes of a certain fund, commonly called The Orphans' Fund) towards defraying the expence of building the faid feffion-house.
