Offender, at the end of confinement, fhall receive a fum of money, &c. not more than five pounds. In profecutions for felony, court may make orders for payment of the profecutor's expences. The charges of the attendance of witnelles to be allowed by the court to poor perfons bound to give evidence against felons. CA P. LXXXIV.

An act for making a navigable canal from Manchefter, to or near Ashtonunder-lyne, and Oldham, in the county palatine of Lancaster.

Certain perfons incorporated by the name of "The company of proprietors of the canal navigation from Manchester, to or near Ashton-underlyne and Oldham." Two plans and books of reference fhall be figned by the speaker of the house of commons. Power to deviate 100 yards from the line laid down in the plan. Errors in defcribing the line, not to prevent making the canal. For erecting and keeping in repair a dam and other works acrofs the river Tame. For erecting and keeping in repair a dam and other works across the river Medlock. Directing what shall be done in cafe the company do not make and fupport the dam, &c. as herein directed. Power for other perfons to communicate with, or cross the canal. Houses, gardens, &c. not to be injured. Breadth of canal and towing paths, thirty yards. No building to be erected on the towing paths, except for the navigation. Power to take water from mines. To oblige proprietors of fire engines to lift their water into the canal and branches. Directing what shall be done with the wafte water. Bodies politick, &c. impowered to fell. Commiffioners for fettling differences. Election of new commiffioners. Impowering the quarter feffions to nominate commiffioners, in cafe the furvivors neglect, or a fufficient number cannot be found in the neighbourhood. Commiffioners may act as juftices. Qualifications of commiflioners to refide in the counties of Lancaster or Chefter, and poffeffed of a real estate of 200l. a year, or personal estate of 5000l. or the eldest son of a peer, or knight of a thire. Fourteen days notice to be given of meeting of commiffioners. On application of the proprietors or land owners, commiffioners to meet. Power to hold occafional meetings. Meetings of commiffioners to be held within one mile of the canal. Commiflioners to fettle differences. Jury to be fummoned in certain cafes. Particular remedies given to the mill owners on the rivers Tame, Merfey, and Medlock, for damages. Perfons requesting a jury, to enter into bond to profecute. Notice of injury to be given to the proprietors, before complaint to the commitioners. Perfons guilty of perjury may be profecuted. Verdict to be recorded, and lands vefted in the proprietors. Application of the purchafe money belonging to corporations, &c. For paying off mortgages on lands uled for the navigation. Comffioners to fettle the proportion of money to be allowed to tenants. Works

Works damaged by the floods, to be repaired by the company. Proprietors to raise amongst themselves 60,000l. The money to be divided into fhares of 100l. each, and be perfonal estate. Subscribers to have a vote for every thare; and not exceeding five votes for cach fubfcriber, nor five for proxies. Proprietors may raife 30,00ǝl. more if neceffary. Power to raife money by mortgage. Mortgages may be transferred. Intereft of money borrowed, to be paid in preference to the dividends, or may be fned for at law. Mortgagees not to vote on account of having lent money. First general affembly to be held on July 27, 1792, and to meet annually on the laft Friday in July. Committee to be appointed. Power to hold fpecial affemblies. Each member of the committee to have but one vote, except the chairman. Committee to be under controul of general affemblies. Books of accounts to be kept. General and special assemblies to conlift of 40 fhares. Powers of general affemblies and committees. Subfcribers to have notice before their fhares are forfeited. Company may remove members of the committee, &c. Make bye laws. Subscribers dying before thares are compleated, executors may complete the fame. In cife of refufal, or want of ailets, proprietors may appoint others. Shares may be difpofed of. No fhare to be fold after call made, until the money is paid. Directions what thall be done on alienations of fhares, by marriage or death. Officers to the company to be appointed. Proceedings of commiffioners to be entered. Rates of tonnage. For lime, limeftone, dung, manure, clay, fand and gravel, one halfpenny per mile a ton. For coal, cannel and minerals not paffing through locks, one penny per mile a ton. For timber, goods and other merchandise not paffing through locks, three halfpence per mile. For coal, cannel and other minerals pafling through locks, three halfpence a mile. For timber, goods and other merchandife paffing through locks, two-pence per mile. Canal to be meafured, and ftones fet up every half mile. Recovery of rates. Payment of wharfage on goods that remain at the wharf above ten days. Power to alter the rates. Rates to be free from taxes. Masters of boats to give an account in writing of particulars of lading. Forty cubic feet of oak, afh, elm or beech, or 50 cubic fect of fir, deal, or poplar, to be deemed a ton weight, and 120lb. avoirdupoife to be a hundred weight. If any difference concerning weight, collectors may weigh or measure boats, &c. Navigation to be free on payment of rates. Veffels under twelve or eight tons, not to pafs locks without confent of proprietors. To prevent lock keepers, &c. giving any prefcrence. Mafters to put their names on outside of their boats. Weight of the lading of veffels to be marked; and veffels to be gauged. Mafters or owners of boats answerable for damages. Mafters to recover back from their fervants any fums paid for their neglect or default. For tencing off towing paths, and making bridges, &c. The company liable to be indicted at common law, for not making stone or brick bridges over the canal. The company liable to be indicted at common law for not repairing bridges, &c. and to pay costs. Justices at the feffions, in certain cafes, to determine what bridges fhall be made. Swivel and draw bridges to be thut and faftened, after veffels fhall have paffed through them, on penalty of 51. In cafe the company do not fence off the towing paths, and make bridges, land owners may do it at the company's expence. If bridges, &c. made by the company, are infufficient, land owners may make others. Lords of manors and land owners may erect warehouses, &c. on their lands. If not done within a limited time, the company may build. Power for owners of mines to make railways for conveying coals, &c. to the canal. Cuts may be made to communicate with the canal and collateral cuts; but not without consent of the owners of lands. Rates of tonnage on private wharfs. Additional rates of tonnage on private wharfs. CA P. LXXXV.

An act for the better relief and employment of the poor of and within fuch
part of the parish of Whitchurch as maintains its own poor, and lies
within the county of Salop.

Guardians of the poor appointed and incorporated by the name of "The
guardians of the poor of that part of the parish of Whitchurch, which lies
within the county of Salop." First meeting of the guardians on Septem-
ber 22, 1792, and to meet annually on the firft Monday in January, April,
July and October. Women to vote by proxy. Guardians and directors
may act as juftices. Directors to deliver in their qualifications. Guardi-
ans and directors to defray their own expences. Directors or officers not
to be concerned in any contract. Guardians at the first meeting to ap-
point a chairman, and also the twelve first directors. Inhabitants of the
parifh ever afterwards to make out a lift of guardians, &c. to be proposed
for directors, to fill up vacancies in the direction. Churchwardens and
overfeers required to call veftries. Directors to accept the offices within
ten days. No perfon to be elected to the office of director within five
years from the date of his quitting the direction, without his confent.
Directors to take an oath. Guardians at their first meeting may appoint
officers, and directors at fubfequent meetings to appoint treafurer and
clerk; governor and steward; matron; fchoulmafter or mitreis, and all
other officers to give fecurity. Weekly meetings of directors. Special
affemblies may be held. Directors may purchafe or hire buildings, lands,
&c.; and erect buildings; and repair, alter, add to and enlarge the fame.
Lands which fhall be purchafed to be rated as heretofore. Buildings to
be furnished. Directors to have the management of the poor, and to pro.
vide for their maintenance and employment. Poor perions to be main-
tained as usual till the house of industry fhall be deemed by the directors
ready for their reception. Power to apprehend poor perfons belonging to
the faid parith. Power to apprehend vagrants. Directors may fend va--
grants to their place of fettlement. Directors may take the examination
of poor perfons, touching their places of fettlement, and represent the
fame to two juftices, requesting the faid juftices to remove them to their
legal fettlements. Children taken in to be apprenticed. Apprentices not
to be affigned without confent of directors. Children may be discharged
out of the houfe, or hired out. Juftice to fettle difputes refpecting wages.
Power to fell the prefent workhouse, and other lands, &c. belonging to
the poor. Charitable donations for the relief of the poor, to be paid to
the treasurer, for the use of the corporation. Churchwardens and over-
feers refusing to receive and pay the fame, to forfeit not lefs than 20s. nor
more than 51. A&t not to extend to any alms houfe, free school, hospital,
or other building of special donation, or lands thereto respectively belong-
ing. Directors to fettle the accounts of churchwardens and overfeers re-
lating to particular charities. Power to borrow 4500l. Power to affign
over all the buildings, &c. belonging to the corporation, as a fecurity for
money borrowed. Power to grant annuities. Annuities to be paid out
of rates. Securities may be transferred. For making affeffiments. Parish
officers to aflift in the execution of the act, and on their making default,
to forfeit not lefs than 40s. nor more than 1ol. Directors may appoint
conftables. Parish officers may raise money, befides the fums requilite for
the purposes of this act. Allowing money for occafional relief to be re-
tained in the hands of churchwardens. Churchwardens, &c. to account
with directors, and pay money collected to the treaturer; on failure
whereof to be committed. Property of furniture, &c. velted in dire&ors;
