CAPITAL PROJECTS

By chapter 54, section 1, of the laws of 1982, and chapter 54, section 3, of the laws of 1984, for:

The sum of fourteen million dollars ($14,000,000) or so much thereof as shall be necessary, is hereby appropriated from the capital projects fund and is authorized to be paid to the New York State housing finance agency for deposit in the housing project repair fund of the New York State housing finance agency pursuant to the provisions of section sixty of the private housing finance law as added by chapter eight hundred eighty-eight of the laws of 1980. Notwithstanding the provisions of section sixty of the private housing finance law or any other general or special law, the agency shall not enter into commitments with housing companies for the correction of construction-related problems in an amount greater than the amount of moneys made available for deposit into the agency's housing project fund. The moneys hereby appropriated, when made available pursuant to a certificate of approval of availablity issued by the director of the budget, shall be paid from the capital projects fund on the audit and warrant of the state comptroller, on vouchers requisitioned by the New York State housing finance agency and approved by the chairman of the agency or his duly designated officer (02188503) ..

The sum of nine million dollars ($9,000,000) or so much thereof as shall be necessary, is hereby appropriated from the capital construction fund and is authorized to be paid to the New York state housing finance agency for deposit in the housing project repair fund of the New York state housing finance agency pursuant to the provisions of section sixty of the private housing finance law as added by chapter eight hundred eighty-eight of the laws of 1980. Notwithstanding the provisions of section sixty of the private housing finance law or any other general or special law, the agency shall not enter into commitments with housing companies for the correction of construction-related problems in an amount greater than the amount of moneys made available for deposit into the agency's housing project repair fund.

Notwithstanding the provisions of any general or special law, no part of such appropriation shall be available for the purposes designated until a certificate of approval of availability shall have been issued by the director of the budget and a copy of such certificate filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee. Such certificate may be amended from time to time, subject to the approval of the director of the budget, and a copy of each such amendment shall be filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee.

Prior to requesting the approval of a certificate of approval for any of the moneys herein authorized, the authority, through commissioner of transportation, shall apply for and take all reasonable steps to secure federal assistance for the capital projects authorized herein. Any and all federal assistance received for such projects shall be used exclusively for the purposes herein authorized and the state payment for each such project shall be reduced by an amount equal to the federal assistance received. In the event that federal assistance is received after the costs of such projects have been met from this appropriation, such federal assistance shall be paid to the state to the credit of the capital construction fund in reimbursement for a portion of the state expenditures undertaken from this appropriation.

The

amounts shown in the schedule below are estimated costs, and, subject to the approval of the director of the budget, may be interchanged with any other project within such schedule except that other projects consistent with capital programs approved by the metropolitan transportation authority capital program review board and approved by a certificate of approval by the director of the budget may be funded from this appropriation upon the certification of the authority that all projects within the schedule will either be completed with funds authorized by this appropriation or transferred to other funding sources supporting the authority's approved capital programs (00757012)....
