Port Development Purpose

By chapter 54, section 1, of the laws of 1982, as amended and reappropriated by chapter 54, section 3, of the laws of 1984:

For construction, reconstruction, and rehabilitation of port facilities under the jurisdiction of the Albany Port District Commission, the Ogdensburg Bridge and Port Authority, the Port of Oswego Authority, and the Niagara Frontier Transportation Authority, including the costs of preparation of master plans, in accordance with the following schedule. Such master plans should provide guidance on potential markets for the ports; specific construction projects that should be undertaken; and the methods for financing any such capital improvements. NEW YORK STATE BRIDGE AUTHORITY (CCP)

Highway Facilities Purpose

By chapter 54, section 2, of the laws of 1981, as amended by chapter 54, section 4, of the laws of 1982, and as reappropriated by chapter 54, section 3, of the laws of 1984, for:

Advance for: The sum of one million, five hundred thousand dollars ($1,500,000), or so much thereof as may be necessary, is hereby appropriated as an advance from the capital projects fund and authorized to be paid as herein provided to the department of transportation as an advance subject to repayment to the New York State Bridge Authority for the Authority's share of costs of planning, design, land acquisition, preliminary engineering studies, including subsurface investigations, and the construction of a parallel Newburgh-Beacon bridge together with incidental roads, approaches, structures and facilities as may be necessary.

Notwithstanding the provisions of any general or special law, no part of this appropriation shall be available for the purposes designated (a) until the New York State Bridge Authority has entered into a written agreement with the director of the budget providing that such New York State Bridge Authority shall annually, on or before March 15, reimburse the state of New York in full for all monies advanced by the State from this appropriation during the then current state fiscal year from any monies available to the authority, subject and subordinate, however, to the rights of the holders of existing notes or bonds of the Authority; and (b) until a certificate of approval of availability shall have been issued by the director of the budget, and a copy of such certificate filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee. Such certificate may be amended from time to time by the director of the budget and a copy of each such amendment shall be filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee.

The comptroller is hereby authorized to receive repayments of the advances made pursuant to this act from said Authority and to deposit the same to the credit of the capital projects fund. The monies hereby appropriated, when made available pursuant to a certificate of approval of availability issued by the director of the budget, shall be paid from the capital projects fund on the audit and warrant of the state comptroller on vouchers approved by the commissioner of transportation and the chairman of the New York State Bridge Authority or their duly designated officers (01396411) (re. $412,000)

PORT OF OSWEGO AUTHORITY (CCP)

Port Development Purpose

By chapter 54, section 2, of the laws of 1981, as last amended by chapter 54, section 4, of the laws of 1982, and as chapter 54, section 3, of the laws of 1984:

Advance for: For payment as an advance to the Port of Oswego Authority of the cost of rehabilitation, reconstruction and improvement of grain handling and storage facilities including associated docks, piers and bulkheads at the Port of Oswego, including the payment of liabilities incurred prior to April 1, 1981.

Prior to requesting the approval of a certificate of approval of availability for any of the moneys herein authorized,

Oswego Authority shall apply for and take all reasonable steps to secure federal and other public and private assistance for the capital projects authorized herein. The State assistance herein authorized shall be reduced by an amount equal to the other public and private assistance received for the authorized projects. In the event that the moneys herein authorized are advanced prior to the actual receipt of other public or private assistance by the authority, such other assistance upon receipt by the authority shall be paid to the State for reimbursement in part or in whole of the advance herein authorized.

The state comptroller is hereby authorized to receive amounts of money equal to the amounts expended from this appropriation at such time and in such manner as shall be agreed in a repayment agreement between the authority and the state director of the budget, and to deposit the same to the credit of the capital projects fund so the State shall be reimbursed for the full amount of any and all such advances.

Upon the issuance of a certificate of approval of availability by the director of the budget, the moneys hereby appropriated shall be paid from the capital projects fund on the audit and warrant of the State comptroller on vouchers approved by the chairman or chief executive officer of the Port of Oswego Authority (01396515).... NIAGARA FRONTIER TRANSPORTATION AUTHORITY (CCP)

Port Development Purpose

By chapter 47, section 7, of the laws of 1966, as last amended by chapter 54, section 4, of the laws of 1982, and as reappropriated by chapter 54, section 3, of the laws of 1984:

Advance to

the department of transportation at the request of and as an advance to the Niagara Frontier Transportation Authority for completion of the Buffalo port development and improvement project, such amount to be in addition and supplemental to the sum of five million, nine hundred thousand dollars ($5,900,000) appropriated by section five of chapter six hundred thirty-three of the laws of nineteen hundred fifty-nine. Notwithstanding the foregoing of the provisions of any general or special law, the chairman shall be paid a salary in the amount determined by the authority and the proceeds of bonds of the authority issued in an aggregate principal amount not in excess of. twenty million dollars ($20,000,000) less the principal amount of any bonds issued prior to the time of calculation by the Niagara Frontier Transportation Authority for purposes in connection with the one or more transportation facilities need not be applied to the reimbursement of the state, as above provided nor need the proceeds of other bonds of the authority be so applied to the extent that

they have been issued to refund the then unpaid principal balance of such bonds, nor need the proceeds of notes of the authority issued in anticipation of the issuance of such bonds or refunding bonds, or in anticipation of the receipt of federal or state aid for any such purposes. In computing the principal amount of any bonds hereafter issued by the Niagara Frontier Transportation Authority there shall not be included the principal amount of such bonds to the extent they have been issued to refund the then unpaid balance of bonds or notes theretofore issued, nor shall there be included the principal amount of notes of the authority issued in anticipation of the issuance of such bonds or refunding bonds, or in anticipation of the receipt of federal or state aid for any purpose (00646415)

NEW YORK STATE THRUWAY AUTHORITY (CCP)

Highway Facilities Purpose

The appropriation made by chapter 54, section 5, of the laws of 1983, and chapter 54, section 3, of the laws of 1984:

The sum of [one hundred million dollars ($100,000,000)] seventy million dollars ($70,000,000), or so much thereof as may be necessary, is hereby appropriated as an advance from any moneys in the capital projects fund to the department of transportation as an advance to the New York state thruway authority for the purposes of carrying out the provisions of section ten-a of the highway law and section three hundred seventy-six of the public authorities law. The money shall be available for projects with or without federal aid. Such sum shall be payable on the warrant of the state comptroller on vouchers certified or approved by the commissioner of the department of transportation or his duly designated representative in the manner provided by law. No part of this appropriation shall be made available for the Westway highway project in New York county. Such funds may be used for obligations incurred before April 1, 1983. No expenditure shall be made from this appropriation until a certificate of approval of availability shall have been issued by the director of the budget and filed with the state comptroller and a copy filed with the chairman of the senate finance committee and the chairman of the assembly ways and means committee. Such certificate may be amended from time to time by the director of the budget and a copy of such amendment shall be filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee.

Such sum shall be payable on the warrant of the state comptroller on vouchers certified or approved by the commissioner of the department of transportation or his duly designated representative in the manner provided by law. Notwithstanding any other provision of law to the contrary, this appropriation shall be available for payment during the four-year period commencing April first, nineteen hundred eighty-two.
