CAPITAL PROJECTS

By chapter 54, section 1, of the laws of 1981, as transferred by chapter 370, section 3, of the laws of 1982, and as amended and reappropriated by chapter 54, section 3, of the laws of 1984:

For payment to the department of transportation for the cost of preparation of designs, plans, specifications, and estimates and for the construction, reconstruction, or improvement at Stewart airport for (1) additional costs of construction of the extension of runway 09-27, (2) security fencing, and (3) acquisition of airport/airfield equipment, notwithstanding the provisions of title one of chapter seven hundred seventeen of the laws of nineteen hundred sixty-seven, as amended in accordance with the projects enumerated above. Prior to requesting a certificate of approval of availability for any of the moneys herein authorized, the commissioner of transportation shall apply for and take all reasonable steps to secure federal assistance for the capital projects authorized herein. Any and all federal assistance received for such projects shall be used exclusively for the purposes herein authorized and the state payment for each such project shall be reduced by an amount equal to the federal assistance received. In the event that federal assistance is received after the costs of such projects have been met from this appropriation, such federal assistance shall be paid to the credit of the general fund of the state of New York ...(re. $159,000)

By chapter 54, section 1, of the laws of 1980, as transferred by chapter 370, section 3, of the laws of 1982, and as reappropriated by chapter 54, section 3, of the laws of 1984, for: Payment to the department of transportation for the cost of preparation of designs, plans, specifications, and estimates and for the construction, reconstruction, or improvement at Stewart airport of (1) an animal export facility, (2) the installation of utilities to the concrete pad area located south of taxiway "A" and east of runway 16-34, and (3) the extension of water and sanitary utilities, a taxiway, and access road to route 17K in the northeast quadrant of the airport, notwithstanding the provisions of title one of chapter seven hundred seventeen of the laws of nineteen hundred sixty-seven, as amended in accordance with the projects enumerated above. Prior

to requesting a certificate of approval of availability for any of the moneys herein authorized, the commissioner of transportation shall apply for and take all reasonable steps to secure federal assistance for the capital projects authorized herein. Any and all federal assistance received for such projects shall be used exclusively for the purposes herein authorized and the state payment for each such project shall be reduced by an amount equal to the federal assistance received. Payment to the department of transportation for the costs of (1) rehabilitation and strengthening of airport taxi lanes, ramps and aprons and (2) Stewart airport master plan, notwithstanding the provisions of title one of chapter seven hundred seventeen of the laws of nineteen hundred sixty-seven. Prior to requesting the approval of a certificate of approval of availability for any of the moneys herein authorized, the commissioner of transportation shall apply for and take all reasonable steps to secure federal assistance for the capital projects authorized herein. Any and all federal assistance received for such projects shall be used exclusively for the purposes herein authorized and the state payment for each such project shall be reduced by an amount equal to the federal assistance received. In the event that federal assistance is received after the costs of such projects have been met from this appropriation, such federal assistance shall be paid to the state to the credit of the general fund of the state of New York (02413214) ...(re. $86,000)

By chapter 54, section

7, of the laws of 1973, as amended by chapter 370, section 3, of the laws of 1982, as transferred by chapter 370, section 3, of the laws of 1982, and as amended and reappropriated by chapter 54, section 3, of the laws of 1984, for: The department of transportation as a supplement to and in accordance with the provisions of chapter 472 of the laws of 1971, as amended. Notwithstanding the provisions of any general or special law, no part of any such appropriation shall be available for the purposes designated until a certificate of approval of availability shall have been issued by the director of the budget and a copy of such certificate filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee. Such certificate may be amended from time to time subject to the approval of the director of the budget and a copy of each such amendment shall be filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee.

The moneys hereby appropriated, when made available pursuant to a certificate of approval of availability, issued by the director of the budget, shall be paid from the capital construction fund on the audit and warrant of the state comptroller on vouchers approved by the commissioner of transportation or his duly designated officer (02413114) (re. $2,577,000)

By chapter 472, section 1, of the laws of 1971, as transferred by chapter 370, section 3, of the laws of 1982, and as amended and reappropriated by chapter 54, section 3, of the laws of 1984, for: The department of transportation is hereby authorized to establish, construct, expand, rehabilitate, improve, maintain, reconstruct and operate at Stewart airport, in the vicinity of Newburgh, New York, an airport for the accommodation of domestic and international air travel and freight transport. The sum of thirty million dollars ($30,000,000), or so much thereof as shall be necessary to accomplish the purposes herein designated is hereby appropriated from the capital construction fund to department of transportation for such purposes, including costs incidental and appurtenant thereto, and
