FORT EDWARD FLOOD CONTROL PROJECT

By chapter 992, section 15, of the laws of 1974, and chapter 54, section 3, of the laws of 1984, for: The cost, cost, including apportionments to other state departments and agencies, for the purpose of land acquisition; channel and bank restoration and stabilization; flood protection including construction of structures; the protection, relocation, alteration or reconstruction of sewer or water facilities or other utilities; dredging and removal of log classification cribs; and all other necessary clean-up and emergency work including obligations incurred prior to April 1, 1974 resulting from or occasioned by the removal of a dam formerly owned by the Niagara Mohawk Power Corporation at Fort Edward. Notwithstanding the provisions of any general or special law this appropriation shall be available for the reimbursement of personal services and expenses for the purposes herein specified (00320357) (re. $172,000)

SHORE PROTECTION

By chapter 54, section 2, of the laws of 1981, as amended by chapter 54, section 4, of the laws of 1982, as reappropriated by chapter 54, section 3, of the laws of 1984:

Advance for: For payment by the state as an advance of the share or shares of the municipality or municipalities of the cost of construction of any erosion-arresting public works, improvement or studies undertaken by the State or the U. S. Army Corps of Engineers, to alleviate or prevent damage resulting from storms along the Atlantic shoreline, the north shore of Long Island and the easterly shore of Staten Island abutting on lower New York Bay or to restore, reconstruct and improve shore protection works damaged by storms. The general public shall not be excluded, either by regulation, discriminatory pricing, or any other means from shorelines for which these state funds are expended.

No portion of this appropriation shall be available for the municipality or municipalities' share or shares of project cost until the municipality or municipalities. have entered into an agreement or agreements with the commissioner of the department of environmental conservation and approved by the director of the division of the budget, providing for repayment to the State of an amount equal to the amount expended from this appropriation. A copy of such agreement or agreements shall be filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee (01387157).... For payment by the State of the share of the Federal government of the costs of acquisition of property, engineering services and construction of a water quality improvement project for the selective removal and encapsulation of PCB contaminated material from the Hudson River in a controlled landfill site or sites. Water Resources Purpose

By chapter 54, section 1, of the laws of 1983, and chapter 54, section 3, of the laws of 1984:

For

the state share of the costs of construction of water quality improvement projects, including the payment of liabilities incurred prior to April one, nineteen hundred eighty-three, in accordance

with the provisions of title three of article fifty-one of the environmental conservation law as amended for projects included in the following schedule, including costs incidental and appurtenant thereto, hereinafter referred to as "Water Quality Improvement Disbursements.

Notwithstanding the provisions of any general or special law, the moneys hereby appropriated shall be available for water quality improvement expenditures for eligible water quality improvement projects as defined by section 51-0303 of the environmental conservation law upon the issuance of a certificate of approval of availability by the director of the division of the budget.

The state comptroller shall at the commencement of each month certify to the director of the division of the budget, the commissioner of environmental conservation, the chairman of the senate finance committee, and the chairman of the assembly ways and means committee the amounts disbursed from this appropriation for Water Quality Improvement Disbursements for the month preceding such certification (02879657) (re. $635,000)

For the state share of the costs of construction of water quality improvement projects, including the payment of liabilities incurred prior to April 1, 1982, in accordance with the provisions of title three of article fifty-one of the environmental conservation law as amended for projects included in the following schedule, including costs incidental and appurtenant thereto, hereinafter referred to as "Water Quality Improvement Disbursements."
