Economic Development Purpose

All state departments, agencies authorities, for projects related to regional economic development, provided that the projects funded herein shall be in accordance with a regional economic development plan coordinated by the commissioner of the department of commerce, subject to the approval of the director of the the budget, with copies of the approved plan filed with the chairman of the assembly ways and means committee and the chairman of the senate finance committee. Such plan shall include projects that: (i) have the potential to attract private investment; (ii) supplement investments or activities of other

departments, agencies, authorities, local governments or the federal government; (iii) provide business development financing including local buyouts, employee ownership initiatives, start-up assistance for minority and women-owned business; (iv) include job training expenses related to economic development projects; or (v) finance infrastructure investments incidental to economic development.

Provided that, in the case of the urban development corporation, the term project shall also be restricted to a land use improvement project, industrial project or civic project as defined in the New York urban development corporation act.

The director of the budget may apportion funds from this appropriation to any departments, agencies and authorities for these purposes provided such departments, agencies, and authorities shall have entered into an agreement providing for repayment to the state of the amount appropriated on terms which may include interest thereon at a rate to be determined by the director of the budget, and a copy of each such agreement shall be filed with the state comptroller and the chairmen of the senate finance and assembly ways and means committees. Notwithstanding the the provisions of section forty-a of the state finance law and any general or special law, in the case of the urban development corpora

tion, such agreements shall not require repayments at any times or on any terms inconsistent with the provisions of the New York state urban development corporation act or the New York state project finance agency act. Except, however, that such departments, agencies and authorities may make grants, pursuant to the regional economic development plan, to projects using funds appropriated herein subject to the approval of the director of the budget and that the repayment provision shall not apply to such grants. The total value of grants shall not exceed fifty percent of the funds appropriated herein. To the extent

practicable and feasible, all projects financed with funds provided herein shall list all new jobs with the job service division of the department of labor and the local job training partnership act service delivery area.

The state comptroller is hereby authorized to receive from such departments, agencies and authorities reimbursement of

moneys expended from this appropriation and to deposit the same to the credit of the capital projects fund (71068560) .....

RESIDENTIAL SCHOOL BED DEVELOPMENT

RESIDENTIAL SCHOOL BED DEVELOPMENT PROGRAM (CCP)

New Facilities Purpose

Notwithstanding any other provision of law
to the contrary, for state aid for pay-
ment of the cost of construction, recon-
struction and improvements, including
the acquisition of property and prepara-
tion of designs, plans, specifications
and estimates for community residential
facilities for children.

No funds shall be made available from this
appropriation until the director of the
council on children and families, the
commissioner of the office of mental
retardation and developmental disabili-
ties, the commissioner of education and
to
the extent required the commissioner
of social services and the commissioner
of the office of mental health have pre-
pared a plan which has been approved by

the director of the budget. Such plan shall contain the following: (a) summary information relating to the number of persons in out-of-state placements and the location, disability, and age of such persons. (b) a procedure for continuously updating information submitted pursuant to paragraph (a) of this section.

(c) an agreement with respect to the dis-
tribution of beds to persons over 21 and
under 21 at facilities effected by this
act. Beds shall mean all beds at any
such facility both existing and planned.
(d) an agreement with respect to the ac-
quisition, construction, rehabilitation,
improvement and certification of resi-
dential facilities funded through the
following amount. Such agreement shall
outline the respective responsibilities
of the commissioner of the office of
mental retardation and developmental
disabilities and the commissioner of
education with respect to the provision
of this paragraph.

(e) any other information necessary to im-
plement the terms of this section.
It shall be the responsibility of the
director of the council on children and
families to submit such plan prepared
pursuant to this section no later than
July first, nineteen hundred eighty-
five. Copies of such plan shall be filed
with the chairman of the assembly ways
and means committee and the chairman of
the senate finance committee.
The appropriation is based upon the total
estimated state share of capital costs.
This state share shall not exceed
thirty-five percent of the total capital
cost of any individual project, unless
specifically approved by the director, of

For the comprehensive construction programs, purposes and projects as herein specified in accordance with the

The sum of fifteen million eight hundred
thousand dollars ($15,800,000), or SO
much thereof as shall be necessary, is
hereby appropriated from

projects fund and is authorized to be
paid to the New York state housing
finance agency for deposit in the
housing project repair fund of the New
York state housing finance agency pur-
suant to the provisions of section sixty
of the private housing finance law as
added by chapter eight hundred eighty-
eight of the laws of nineteen hundred
eighty.
Notwithstanding the provisions of section
sixty of the private housing finance law
or any other general or special law, the
agency shall not enter into commitments
