CAPITAL PROJECTS

the interstate cost estimate approved in
nineteen hundred eighty-five in public
law 99-4 of the United States and any
other elements subsequently added to the
project. Notwithstanding any other
provision of law including this chapter.
no part of this appropriation shall be
apportioned to any other department
agency or authority. No expenditures
shall be made from this appropriation
for personal services and expenses of
the department of transportation.
Notwithstanding any other provision
law all obligations of the state for
the costs of the Westway project, during
state fiscal year 1985-86 shall be made
from this appropriation; provided how-
ever payments may be made for those ser-
vices and expenses appropriated for the
Westway management program in a chapter
of the laws of 1985 as proposed in
legislative bill number S. 1051/ A. 1351
as amended. Notwithstanding any other
provisions of law, the comptroller shall
create a separate account within the
federal capital projects fund for the
purposes of this appropriation. The
comptroller shall record all receipts
credited to such account from federal
reimbursements for Westway disbursements
for capital purposes.

The federal capital projects funds shall
become available only when the federal
highway administration shall notify the
commissioner of transportation (a) that
particular Westway projects that have
been submitted by the commissioner of
transportation to the federal highway
administration, have been approved: and
(b) that the required share of federal
funds have been apportioned to the state
of
New York for expenditures in accord-
ance with federal laws relating to
federal-aid.

committee: (a) prior to the department
of transportation entering into a con-
tract without the necessary federal
authorization for reimbursement: and (b)
when the federal government denies reim-
bursement after approval for reimburse-
ment of any contract.

Prior to the obligation of any funds for
costs other than consultants or land ac-
quisition, the Governor and the Mayor of
New York City shall enter into a written
agreement concerning future funding for
Westway and the Governor shall provide
copies of such agreement to the tem-
porary president of the senate and the
speaker of the assembly. Such agreement
shall include funding sources (state.
city or other sources) for any items in
the future that may not be federally
reimbursed and for the local match for
items reimbursed from other than the
federal aid interstate highway program.
The items in the following schedule are
projects with a common purpose and
such may be interchanged without limita-
tion subiect to the approval of the
director of the division of the budget.
This appropriation is made for the

The

for

sum of five million ($5,000,000) is hereby appropriated the design, acquisition of property, and construction of highway and bridge projects related to industrial access. For the purposes of this appropriation, industrial access shall also include improvements that would benefit the agricultural industry. No funds shall be allocated for such purposes until the commissioner enters into an agreement subject to the approval of the director of the budget with any public or private entity for the repayment of forty percent of the cost of such project within five years of the execution of the agreement. All funds shall be repaid to the credit of the capital projects fund. All projects must be approved by the director of the budget prior to the obligation of any funds from this appropriation.
