CAPITAL PROJECTS

For the payment of the cost of preparation of plans and estimates, and for the cost of construction for the rehabilitation, conversion or construction of alternative residential facilities located on the grounds of various state psychiatric centers, provided, however, that no allocations shall be made from this appropriation for residential care centers for adults (RCCA's) except pursuant to a chapter of the laws of 1985. OFFICE OF MENTAL RETARDATION AND DEVELOPMENTAL DISABILITIES

For the comprehensive construction programs, purposes and projects as herein specified in accordance with the following:

State aid to municipalities and other pu-
blic and not-for-profit private agencies
for
acquisition of property, construc-
tion and rehabilitation of community
mental retardation vacilities pursuant
to article 41 for the mental hygiene
law. Such aid shall be utilized for the
cost effective expansion of existing day
program services and the establishment
of new day program facilities for under-
served persons over 21 including the
aging out and other needy individuals
living at home. Notwithstanding the
provision of section 41.27 of such law
and any other inconsistent provision of
law, the moneys hereby appropriated may
be available for payment of state aid.
No expenditure shall be made from this
appropriation until a spending plan for
proposed projects has been submitted by
the commissioner of the office of mental
retardation and developmental disabili-
ties and approved by the director of the
budget. Such plan shall be filed with
the state comptroller, the chairman of
the senate finance committee and the
chairman of the assembly ways and means

The total appropriation below is based
upon the total estimated state share for
capital costs of projects. Notwithstand-
ing any other provision of law the fol-
lowing amount shall not be transferable
