CITY OF MOUNT VERNON

LOCAL LAW No. 1

A local law in relation to choosing the president of the common council, and his acting as mayor in case of vacancy in that office.

Became a law February 9, 1926, with the approval of the Mayor. the local legislative body of the city of Mount Vernon.

Be it enacted by the common council of the city of Mount Vernon as follows:

Section 1. Sections thirty-three and sixty-one of chapter four hundred and ninety of the laws of nineteen hundred and twentytwo, entitled "An act to provide a charter for the city of Mount Vernon," are hereby superseded and enacted as local law, amended, respectively, to read as follows:

§ 33. Members; president; organization. The aldermen of the city shall constitute the common council thereof. The members of the common council shall meet in the room provided for the purpose at eight o'clock in the evening of the second day of January, nineteen hundred and twenty-three, and each year thereafter, or if that day be Sunday or a legal holiday, then on the next day, and organize. The common council at its first meeting annually shall elect from among its members a president of the common council who shall preside at all meetings and discharge other duties as may be defined by ordinance of the common council and otherwise by this chapter or by law, and a president pro tempore who shall have the power of the president of the common council during the absence or disability of the president or while the president is acting as mayor. The president of the common council shall vote as a member of the common council notwithstanding he shall be acting as mayor. The president pro tempore of the common council shall also vote as a member of the common council. The common council shall also constitute and appoint such other officers and committees as may be needed for the execution of the powers herein and hereby granted to the common council.

§ 61. Acting mayor. Whenever there shall be a vacancy in the office of mayor, or whenever by reason of sickness or absence from the city the mayor shall be prevented from attending to the duties of the office, the president of the common council shall act as mayor and possess all the rights of the mayor during such period of disability or absence. In case of a vacancy in the office of mayor, he shall so act until the first day of January next succeeding the election at which the mayor's successor shall be chosen notwithstanding that his term as president of the common council shall have expired prior to such date, but shall not act as mayor after his term of office as alderman has expired. It shall not be lawful for the president of the common council when acting as mayor in con

sequence of the absence or sickness of the mayor to exercise any power of appointment or removal from office unless such sickness or absence shall have continued for a period of sixty days. § 2. This local law shall take effect immediately.

LOCAL LAW No. 2

A local law in relation to the confirmation and lien of local assessments and the payment of interest on installments.

Became a law April 1, 1926, with the approval of the Mayor. Passed by the local legislative body of the city of Mount Vernon.

Be it enacted by the common council of the city of Mount Vernon as follows:

Section 1. Article fifteen of chapter four hundred and ninety of the laws of nineteen hundred and twenty-two, entitled “An act to provide a charter for the city of Mount Vernon," is hereby amended by adding at the end two new sections to be sections two hundred and thirty-a and two hundred and forty-two-a, to read, respectivly, as follows:

§ 230-a. Confirmation and lien of local assessments. If the whole or any portion of the expense of a public improvement be assessed or charged upon the property affected by such improvement, such assessment shall be confirmed by the common council, after a public hearing shall have been had, at which any person interested may present written objections to such confirmation. Notice of the time and place of such hearing shall be published in the official paper of the city at least ten days prior to the hearing. The title of such assessment, with the date of confirmation by the common council, shall be entered, with the date of such entry, in a record of the titles of assessments confirmed and shall be kept in the office of the commissioner of taxes and assessments.

§ 242-a. Interest on assessments for local improvements. If an assessment for a public improvement be made payable in installments, as provided by section forty-three of this act, one installment, with interest at the rate of five per centum on the amount of such assessment remaining unpaid, shall be due and payable and be a lien upon the property assessed, on each recurring annual anniversary of the date of the entry of the assessment in the record of titles of assessments confirmed in the office of the commissioner of taxes and assessments. An installment not due with interest at the rate of five per centum to the date of payment may be paid at any time, if all installments then due, with the interest thereon, shall have been paid. Any installment not paid when due, shall bear interest at the rate of eight per centum per annum from the time when it shall have become a lien.

§ 2. This local law shall take effect sixty days after its adoption.

LOCAL LAW No. 3

A local law in relation to the duties of the city clerk.

Became a law April 1, 1926, with the approval of the Mayor. Passed by the local legislative body of the city of Mount Vernon.

Be it enacted by the common council of the city of Mount Vernon as follows:

Section 1. Section thirty-four of chapter four hundred and ninety of the laws of eighteen hundred and ninety-two, entitled "An act to provide a charter for the city of Mount Vernon," is hereby superseded, and enacted as local law, amended to read as follows:

§ 34. The common council shall appoint to hold office during its pleasure, a city clerk, who shall attend the meetings of the common council, keep a journal of its proceedings and discharge such other duties as may be prescribed by this chapter or by law or ordinance. He shall appoint to hold office during his pleasure, except as otherwise provided by law, such subordinates as may be prescribed by the board of estimate and contract. It shall be the duty of the said clerk to transmit to the head of each department and clerk of each board copies of all ordinances in any manner affecting any of the matters of which any such department or board shall have jurisdiction. He shall have the custody of the city seal and shall be the clerk to all boards unless otherwise provided by law or by the board of estimate and contract, or by this chapter. The city clerk shall be ex-officio, a commissioner of deeds. The city clerk shall keep an accurate account of all moneys received and disbursed by him under or in pursuance of any provision of law or ordinance; and shall deposit all his receipts daily to the credit of the city in one or more of the city depositaries designated pursuant to law, and shall report such receipts and disbursements monthly, in detail, and pay over the balance thereby shown, to the comptroller on or before the fifth day of every month.

§ 2. This local law shall take effect immediately.

LOCAL LAW No. 4

A local law in relation to the signing of checks or drafts against city funds. Became a law April 1, 1926, with the approval of the Mayor. Passed by the local legislative body of the city of Mount Vernon.

Be it enacted by the common council of the city of Mount Vernon as follows:

Section 1. Section ninety-one of chapter four hundred and ninety of the laws of nineteen hundred and twenty-two, entitled "An act to provide a charter for the city of Mount Vernon," is hereby superseded, and enacted as local law amended to read as follows:

91. Duties of the comptroller. The comptroller shall superintend the financial affairs of the city and manage the same pursuant to law and ordinances of the common council. He shall keep a separate account with every department, and with each improvement for which funds are appropriated or raised by tax or assessment. No warrant shall be drawn by him for the payment of any claim against or obligation of the city unless it states particularly against which of such funds it was drawn. No funds shall be overdrawn nor shall any warrant be drawn against one fund or appropriation to pay a claim chargeable to another. The comptroller shall demand, collect, receive and have the care and custody of and shall disburse all moneys belonging to or due the city from every source, except as otherwise provided by law. The amount of taxes directed by the board of supervisors to be levied in the city for state purposes shall be paid on or before the fifth day of May in each year and for county purposes shall be paid by the city, onehalf on or before the fifteenth day of May and the other half on or before the first day of October, and such payment shall be made to the county treasurer or be deposited to his order in such bank in the city of Mount Vernon as he may direct. The comptroller shall deposit daily to the credit of the city all moneys of the city received by him in such banks or trust companies as shall be designated by the board of estimate and contract. The interest upon all deposits shall be the property of the city and shall be accounted for and credited to the appropriate fund. No money shall be drawn from the city depositary except on check or draft signed by the comptroller, or the deputy comptroller, and made payable to the person · entitled to receive the same. Every check or draft against the city funds shall bear reference to the claim or demand in payment of which it is issued. The comptroller shall perform such other duties as may be from time to time be prescribed by law, or by ordinance of the common council, not inconsistent with the provisions of this chapter, or the laws of the state.

§ 2. This local law shall take effect immediately.

LOCAL LAW No. 5

A local law in relation to the appointment of a deputy commissioner of public health.

Became a law May 14, 1926, with the approval of the Mayor. Passed by the local legislative body of the city of Mount Vernon.

Be it enacted by the common council of the city of Mount Vernon as follows:

Section 1. Section one hundred and thirty-two of chapter four hundred and ninety of the laws of nineteen hundred and twentytwo, entitled "An act to provide a charter for the city of Mount

Vernon," is hereby superseded and enacted as local law, amended to read as follows:

§ 132. Commissioner of public health; deputy commissioner; subordinates. The commissioner of public health shall be the head of the department of public health. He shall appoint, to hold office during his pleasure, except as otherwise provided by law, a deputy commissioner of public health, and such subordinates as may be prescribed by the board of estimate and contract. In case of the absence or disability of the commissioner or a vacancy in the office, the deputy may discharge the duties of the office until the commissioner returns, his disability ceases or the vacancy is filled. § 2. This local law shall take effect immediately.
