Stock Transfer Tax Fund

amount paid into such fund on nineteen hundred eighty-five. Notwithstanding the provisions of section 92-i of the state finance law or any other law to the contrary, upon receipt of the certification of the commissioner of taxation and finance provided for in subdivision four of such section 92-i for the calendar quarters ending September thirtieth, nineteen hundred eightyfive, December thirty-first, nineteen hundred eightyfive and March thirty-first, nineteen hundred eightysix, the comptroller shall determine the amount payable by the state as one-half of the revenue loss to the city of New York for such calendar quarter as rebates of stock transfer taxes and the expiration of the twenty-five percent surcharge on transactions subject to the stock transfer tax. Upon making such determination, the comptroller shall forthwith pay into the stock transfer incentive fund an amount equal to the lesser of the amount so determined or the difference between the total appropriation herein provided and the amounts determined to be payable into the stock transfer incentive fund on October fifteenth and December fifteenth, nineteen hundred eighty-five. In no event shall the amount paid into the stock transfer incentive fund exceed the amount appropriated herein

The sum of twenty-three million fifty-seven thousand two hundred twenty-seven dollars ($23,057,227), or so much thereof as may be necessary, is hereby appropriated for transfer to the tax stabilization reserve fund for payment of prior withdrawals.

Local Assistance Account

Notwithstanding the provisions of any other general or special law, no part of such appropriation shall be available for the purposes designated until a certificate of approval of availability shall have been issued by the director of the budget and a copy of such certificate filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee. Such certificate may be amended from time to time, and a copy of each such amendment shall be filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee

State aid for services and expenses, including general operating expenses, to botanical gardens, zoos, and aquariums including one million, three hundred fifteen thousand dollars ($1,315,000), for programs outside the City of New York. Eligible institutions that have a master plan for a capital construction program that has not been completed, and have previously received financial support from the Natural Heritage Trust for capital improvements may, at the institution's discretion, use any funds awarded from the Trust to further its capital construction program pursuant to its master plan

Notwithstanding the provisions of any general or special
law, no part of this appropriation shall be made availa-
ble for payment for the purposes designated until a cer-
tificate of availability shall have been issued by the
director of the budget, and a copy of such certificate
of availability, or any amendments thereto, filed with
the state comptroller, the chairmen of the senate
finance committee and the assembly ways and means
committee. The monies hereby appropriated, when made
available shall be paid on the audit and warrant of the
state comptroller on vouchers approved by a duly
authorized officer of the city of New York
