of the ftatute in fuch cafe made and provided, it is confi-
dered by the faid court here, that the faid W. B. the
younger, take nothing by his faid writ, but that he be in
mercy, &c. and that the faid mayor and burgeffes of
the faid town of N. upon T. in the county of the town of
N. upon T. aforefaid, do go without day in this behalf.
And it is alfo confidered by the faid court here, that the
faid mayor and burgeffes do recover against the faid W. B.
the younger, the fum of
