cause to come before our faid present fovereign lord the king at W. on Thursday next after the morrow of All Souls, twelve free and lawful men of the body of their faid faid city of L. by whom the truth of the matter may be better known, and who are not of the kindred of the faid T. M. to try upon their oath the faid feveral iffues fo above joined as aforefaid, because as well the faid J.T. efquire, who for our faid lord the king in this behalf profecuteth, as the faid T. M. have thereupon put themfelves upon the faid jury, the fame day is given as well to the faid J. T. esquire, who for our faid lord the king in this behalf prosecuteth, as to the said T. M. on which faid Thursday next after the morrow of All Souls, before our faid lord the king at W. come as well the faid J. T. efquire, who for our faid lord the king in this behalf prosecuteth, as the faid T. M. by his clerk in court aforefaid; and the sheriffs of the faid city of L. have returned the names of twelve jurors, none of whom come to try the said several issues so above joined as aforefaid, therefore the sheriffs of the faid city of L. are commanded that they diftrain the bodies of the faid jurors aforefaid by all their lands and chattels, fo that neither they nor any one of them do put their hands to the fame, until they fhall have another command from our faid lord the king for that purpose, and that they answer to our faid lord the king for the iffues thereof, fo that they may have their bodies before our faid lord the king at W. on Friday next after the octave of Saint Hilary, or before the right trufty and well beloved of our faid lord the king Lloyd lord Kenyon, chief juftice of our faid lord the king, affigned to hold pleas before the king himfelf, if he fhall come before that time, that is to fay, on Monday next after the end of the term, at the Guildhall within the faid city of L. according to the form of the ftatute in fuch case made and provided, to try upon their oath the said several iffues fo above joined as aforefaid, in default of the jurors aforefaid, who came

B. A. A. of B. S. W. P. of W. S. and Q. D. of K. S. merchants, come and are fworn upon the faid jury, and because the rest of the jurors of the faid jury do not appear, therefore others of the by. ftanders named and approved for that purpose by the sheriffs of the said city of L. at the request of Sir. J. S. knight, attorney general of our faid lord the king, by the command of the faid chief juftice are newly appointed, whose names are added to the pannel according to the form of the ftatute in fuch cafe made and provided; which faid jurors fo newly appointed, to wit, W. of the fame, fmith, being called, likewife come and are also fworn upon the faid jury: whereupon the court here proceedeth to the taking of the inqueft aforefaid, as well by the jurors aforefaid firft impannelled and fworn as by the other jurors now here appearing, who together with the jurors aforefaid first impannelled and fworn, being chofen, hired and fworn to speak the truth, touching and concerning the matters within contained, fay upon their oath as to the first issue within joined, that the faid T. M. by the greater part of the then mayor of the faid city of C. and the rest of the citizens of the fame city, being of the council house of the fame city, in the faid council house then in council, was lawfully and in due manner elected and added to be one of the council house of the said city, in manper and form as the faid T. M. hath in his plea within alledged and the jurors aforefaid, upon their oath aforesaid, as to the second iffue within joined, further fay, that the faid T. M. at the time of his using and exercising the said place, office and franchife of one of the council house of the faid city, as in the faid information is alledged, was, and hath been admitted to the faid place, office and franchise of one of the council house of the faid city in manner and form as the faid T. M. hath in his rejoinder to the replication within alledged.
