Let us now examine what has been the conduct of Sir Charles Grey in the manner of fulfilling these measures:

Guided by that love of juice which diftinguishes him, by that goodness which is the foundation of his, character, lamenting the meafures equity and public fafety obliged him to take, he has neglected nothing to come at the truth. He has taken every poffible precaution to prevent private animofity from having any influence on thofe operations; he has fpared neither his time, nor pains and trouble, to discover the errors into which he might have been led. Sometimes, through the apprehenfion of being unjuft, he has preferred rather to be lefs prudent, and in the contest between his opinion and the goodness of his heart, the latter has always had the advantage. With regard to the property of individuals killed in arms, abfent fugitives, or tranfported, he has done every thing that was humanely poffible to prevent depredation. Wife regulations, the execution of which has been entrusted to honeft and able men, have established order in that department-have continually fought the means of prefervation, and prepared things in fuch a manner, that the intentions of his Majefty on that fubject will be cafily fulfilled when known.

Such is, Sir, the opinion of the court. It was its duty to manifeft it, in order to let nothing be unknown to his Majefty's minifters of what may contribute to the peace and prosperity of this colony, and in order to do that justice which is due to a commander, whofe pure, upright, and benevolent intentions have difplayed themselves in numerous circumstances undoubtedly. If, being almost constantly taken up with military operations, and if, finding it impoffible to obferve every thing himself, it has been totally out of his power in fuch a fhort space of time to make this colony reap all the advantages he wished, he has however procured to it very great ones progreffively, and his continual care will procure more. But his conduct has particularly been worthy of praise in the line in which I am efpecially directed to converfe with you; and I am now to beg of you, Sir, in the name of the court, to declare to his Majefty's minifters, that if the colony of Martinique, in the series of disturbances and danger by which it has been furrounded, and notwithstanding the efforts of agitators, has enjoyed fome tranquillity, we are indebted for it to the measures taken on that point by the commander in chief.

Separate Inftructions for our trufty and well-beloved Sir Charles Grey, Knight of the Moft Hon. Order of the Bath, and Lieutenant-General of our Forces, whom we have appointed General and Commander in Chief of our Forces, employed or to be employed in the West Indies. Given at our Court at St. James's, the

Day of November 1793, in the thirty-fourth Year of our Reign.

Whereas it has been reprefented to us, that it may be neceffary, for prevention of all difputes that might otherwife arife concerning the diftribution of booty gained from the enemy at land during the prefent expedition, that certain rules and proportions should be laid down and fettled for the distribution thereof: Now, being defirous to preferve that harmony and good understanding between our land and fea forces, which is neceffary for the carrying on this fervice with fuccefs, we have thought fit to order, and we do hereby order and direct, that you do fettle with Sir John Jervis, or with the commander in chief of our fhips, in what manner and proportion booty taken from the enemy at land during the prefent expedition fhall be diftributed between our land and fea forces, in all cafes where the faid land and fea forces fhall be jointly engaged in the attacking and taking of any place, fort, or fettlement from the enemy.

And that you may be apprifed of fuch methods as have been heretofore taken in the like cafes, we have ordered two copies of former Regulations to be delivered to you with thefe our Inftructions. whereof one is an order made for the diftribution of prizes and booty that fhould be taken in the Weft Indies in an expedition against the French iflands, under the command of Commodore Wilmot, in the year 1694; and the other a Regulation settled by her late Majefty Queen Anne, for the diftribution of prizes and booty, that should be taken from the enemy in the year 1702, in an expedition defigned to have been commanded by the Earl of Peterborough; together with a Paper that had been prepared in the year 1740, in conformity to the two preceding fettlements, fo far as they are not repugnant to provifions made in this behalf by fubfequent Acts of Parliament; and likewife certain Plans for the diftribution of the prizes and booty, which had been taken at St. Eustatius by the late Lord Rodney and Major General Vaughan, tranfmittted by my orders for their confideration and opinion thereon, in a letter from the late Lord Viscount Sackville, then being one of our principal Secretaries of State; whereby you may be the better enabled to form fuch difpofitions and regulations for the dif tribution of booty gained from the enemy at land, during the prefent expedition, as may be agreeable to juftice and to former practices on the like occafions. And whereas it is our royal intention that our refpective corps of black dragoons, pioneers, and artificers, who may ferve in this expedition, fhould have an equal share in all booty

gained from the enemy, in common with our regular troops, you are hereby directed to take care, that in all difpofitions the faid corps be confidered, and have their share of fuch booty allotted to them, in proportion to their respective numbers, ranks, and pay: You will alfo take care that, in fuch difpofitions, a proper regard be had to all negroes who fhall attend this expedition, and to all pealants and others working to clear ground, affifting at fieges, or otherwife employed in any military service.

Whereas by our proclamation, bearing date the 19th of this inftant June, we have directed in what manner and proportion all prizes taken at fea, during the prefent war with Spain, fhall be diftributed, pursuant to the power referved to his Majesty for that purpofe, by an Act paffed the laft feffion of Parliament, intituled, "An Act for the more effectual fecuring and encouraging the trade of his Majefty's British fubjects in America, and for the encouragement of feamen to enter into his Majesty's fervice," as by our faid proclamation, reference being thereunto had, may more fully ap pear:

And whereas it will also be neceffary to prevent all difputes that may arife during the prefent expedition about hooty taken from the enemy at land, that certain rules fhould be laid down, and proportions fettled, for the distribution of such plunder; we have thought fit to order and direct, and we do hereby order and direct,

That in all cafes where his Majefty's land and fea forces fhall be equally engaged in the attacking or taking of any place, fort, or country from the enemy, the booty there gained fhall be distributed between the faid land and fea forces engaged in fuch enterprise in the manner following; viz.

The whole amount of fuch booty fhall be divided into fifteen equal parts or portions,

Whereof 5 15th fhall be given to the two Com5-15th manders in Chief of the land and fea forces, to be equally divided between them.

To the other General Officers, Admirals, and Com1-15 modores, to be divided amongst them, in proportion to their respective falaries 1

The remaining 6 parts to be divided amongst all the Non-commiffion Officers at land and fea, Soldiers and Sailors, in proportion to their refpective pay or falary, excepting only as hereafter is provided.

2. In which diftribution Commanders in Chief by land and by fea fhall be equally confidered; Rear Admirals thall be accounted as Major Generals; Commodores wearing broad pendents as Brigadier Generals; Captains of the fhips of line of battle as Colonels; Captains of leffer fhips of war, giving rank, as Lieutenant Colonels; Malters and Commanders of fire fhips, bomb ketches, floops, and other hips of war, not giving rank, as Majors; Lieutenants at fea, and Masters of fhips, giving rank, as Captains of the land forces; Gunners, Purfers, Boatfwains, and Cooks, as Lieutenants of land forces; Midshipmen, and all other petty officers at fea, as Serjeants of the land forces, notwithstanding any disparity between the pay and falary of fuch land and fea Commanders; and fhall receive their portion of plunder accordingly. It is likewife our pleafure that all Soldiers and Sailors, notwithstanding any difparity in their pay, be equally confidered and receive their respective fhares accordingly.

3. But whenever the fervice done fhall be carried on by the land forces only, then the whole booty fhall be divided amongst them, in the following manner:

4. It is likewife our intention that in both the afore-mentioned diftributions, Commiffaries of ftores and provifions, and all the

Commiffion and Non-commiffion Officers, Engineers, Gunners, Matroffes, Artificers, and Soldiers belonging to the train of artillery attending this expedition, be confidered and have their share of the faid plunder, in proportion to their ranks and salaries.

5. But no Officer fhall be allowed to fhare in two capacities, (that is to fay) both as a General Officer and Colonel of a regiment, or as Adjutant and Lieutenant, as the cafe may happen; and whenever any person shall hold two different employments, he fhall chufe in which of them he will take his dividend; but it is not hereby intended to exclude Colonels, Lieutenant Colonels, and Majors from receiving their shares as Captains, as well as Field Officers.

6. And whereas his Majefty, by inftructions to his Governors of his colonies on the continent of North America, and to his Governor of the Leeward Iflands, has declared it to be his royal intention, that the forces ordered to be raised by the faid Governors for his Majefty's fervice, and to attend this expedition, shall have an equal fhare in all plunder gained from the enemy, in common with the rest of his Majefty's troops: Now you are hereby directed to take care, that in all distributions the faid American levies be confidered, and have their fhare of all booty, in proportion to their refpective ranks and pay accordingly.

7. We do alfo think fit to direct that Pioneers or Peasants working to clear grounds, and affift at fieges, fhall be confidered, and have their diftribution of booty equally with the common Soldiers; and that every Officer, Soldier, or Seaman, that shall happen to be wounded in any fiege or action where booty fhall be taken, fhall have a double thare in proportion to his rank, in confideration of fuch wounds.

ANNE R.

The Distribution of Prizes and Booty that fhall be taken from the Enemy in the West Indies.

That of all the prizes taken at fea, her Majefty do, in the first place, referve to herself and the States General, all guns, arms, and ammunition, the hulks, fails, cordage, anchors, naval ftores, and provifions of fhips of war.

That the whole remainder, after deducting the tenths for the Lord High Admiral, her Majefty and the States General shall

have two thirds.

That the remaining third (after fuch defalcation) fhall be divided into fixteen parts, and diftributed as follows:
