LOCAL LAW No. 3

A local law in relation to the officers and how they shall be chosen.

Became a law August 5, 1924, with the approval of the Mayor. Passed by the local legislative body of the city of Mechanicville.

Be it enacted by the council of the city of Mechanicville as follows:

Section 1. All the elective officers of the city shall be chosen at a general municipal election, except as otherwise provided.

§ 2. The general municipal election shall be held on the first Tuesday succeeding the first Monday in November in every oddnumbered year.

§ 3. Section eleven of chapter one hundred and seventy of the laws of nineteen hundred and fifteen, entitled, "An act to incorporate the city of Mechanicville," is hereby superseded. § 4. This local law shall take effect immediately.

LOCAL LAW No. 4

A local law in relation to the appointment of election officers. Became a law August 5, 1924, with the approval of the Mayor. Passed by the local legislative body of the city of Mechanicville.

Be it enacted by the council of the city of Mechanicville as follows:

Section 1. There shall be a general municipal election held on Tuesday, next succeeding the first Monday in November, nineteen hundred and twenty-five, and every odd-numbered year thereafter, there shall be held on the Tuesday next succeeding the first Monday in November, a general municipal election.

The council shall appoint the inspectors of election and such other officers as are now required by the general law of the state of New York to conduct general elections, and in all things the general election law of the state of New York shall govern as applicable to cities of like size, except as herein otherwise provided. Such inspectors of election, and other officers so appointed, shall perform all the duties required by the election officers at the general municipal election and at the municipal primary election.

§ 2. Section fifty-seven of chapter one hundred and seventy of the laws of nineteen hundred and fifteen, entitled "An act to incorporate the city of Mechanicville" is hereby superseded. § 3. This local law shall take effect immediately.

LOCAL LAW No. 5

A local law in relation to general and special municipal elections.

Became a law August 5, 1924, with the approval of the Mayor. Passed by the local legislative body of the city of Mechanicville.

Be it enacted by the council of the city of Mechanicville as follows:

Section 1. A general municipal election shall be held in the city of Mechanicville on the Tuesday succeeding the first Monday in November in every odd-numbered year, beginning with the year nineteen hundred and twenty-five. The commissioners provided for in this charter shall be elected in* at such elections. Every such election shall be known as the general municipal election. Every other municipal election held under the provisions of this charter shall be known as a special municipal election. Of the officers elected at the first general municipal election, as required by chapter fifty of the laws of nineteen hundred and twenty-four, entitled "An act to provide for the election of city officers in certain cities and their terms, and for temporary appointments to facilitate carrying into effect section six of article twelve of the constitution," the commissioner of public safety, whose term of office is extended by such act until the thirty-first day of December, nineteen hundred and twenty-five, shall hold office until the thirty-first day of December, nineteen hundred and twenty-five, and until his successor in office qualifies. The commissioner of public works, whose office is extended by this act, shall continue in office until the thirty-first day of December, nineteen hundred and twenty-five, and until his successor in office qualifies. The commissioner of finance shall continue to hold office until the thirty-first day of December, nineteen hundred and twenty-five, or until his successor in office qualifies. The commissioner of accounts shall continue to hold office until the thirty-first day of December, nineteen hundred and twenty-seven, or until his successor in office qualifies. The mayor shall continue to hold office until the thirty-first day of December, nineteen hundred and twenty-five, or until his successor in office qualifies.

The successor of the commissioner of public safety shall be elected at the general municipal election in the year nineteen hundred and twenty-five for a full term of two years beginning on the first day of January in the year nineteen hundred and twenty-six and every second year thereafter at the general municipal election there shall be elected a commissioner of public safety for a full term beginning on the first day of January following such election.

The successor to the commissioner of public works shall be elected at the general municipal election in the year nineteen hundred and twenty-five for a full term of two years, beginning

on the first day of January, nineteen hundred and twenty-six; and every second year thereafter at the general municipal election there shall be elected a commissioner of public works for a full term beginning on the first day of January following such election. The successor to the commissioner of finance shall be elected at the general municipal election in the year of nineteen hundred and twenty-five for a full term of four years, beginning on the first day of January, nineteen hundred and twenty-six; and every fourth year thereafter at the general municipal election there shall be elected a commissioner of finance for a full term beginning on the first day of January following such election. The successor to the mayor shall be elected at the general municipal election in the year nineteen hundred and twenty-five for a full term of two years, beginning on the first day of January, nineteen hundred and twenty-six; and every second year thereafter at the general municipal election there shall be elected a mayor for a full term of two years beginning on the first day of January following such election. The successor to the commissioner of accounts shall be elected at the general municipal election in the year nineteen hundred and twenty-seven for a full term of four years beginning on the first day of January, thereafter; and every four years thereafter at the general municipal election, there shall be elected a commissioner of accounts whose term of office shall begin on the first day of January following such election.

No officer whose term shall have expired shall cease to hold office until his successor shall have qualified.

The council of the city, together with the supervisor, shall constitute the board of canvassers for all municipal elections.

§ 2. Section one hundred and eleven of chapter one hundred and seventy of the laws of nineteen hundred and fifteen, entitled, "An act to incorporate the city of Mechanicville," as amended by chapter seventy-four of the laws of nineteen hundred and twentyone and as amended by chapter five hundred and fifteen of the laws of nineteen hundred and twenty-one, is hereby superseded. § 3. This local law shall take effect immediately.

CITY OF MIDDLETOWN

LOCAL LAW No. 1

A local law in relation to public hearings before the mayor on local laws.

Became a law July 14, 1924, with the approval of the Common Council. Passed by the local legislative body of the city of Middletown.

Be it enacted by the common council of the city of Middletown as follows: Section 1. Whenever a local law after its passage by the common council shall be presented to the mayor for approval he shall forthwith fix a day for a public hearing concerning such local law and cause public notice of the time and place of such hearing to be given. Such notice shall be given by publication for two successive days in the official newspaper published in the city. Such hearing shall be held not earlier than five days after the day of the last publication of such notice. Such notice shall contain the title of the local law and either an explanatory statement concerning the same, or the full text of the law, as the mayor may determine. The mayor shall attend at the time and place appointed for such hearing and afford an opportunity for a public hearing concerning such local law. Such hearing may be adjourned from time to time, but an adjournment shall not operate to extend the time of the mayor to approve such local law or return it to the common council with his objections, pursuant to the city home rule law.

§ 2. This local law shall take effect immediately.

LOCAL LAW No. 2

A local law amending section six of the charter of the city of Middletown, relating to election of city officials, so as to provide for the holding of municipal elections in odd-numbered years.

Became a law July 28, 1924, with the approval of the Mayor. Passed by the local legislative body of the city of Middletown.

Be it enacted by the common council of the city of Middletown as follows: Section 1. Section six of title two of chapter five hundred and seventy-two of the laws of nineteen hundred and two, entitled 'An act to revise and amend an act to incorporate the city of Middletown, and the acts amendatory thereof" as last amended by chapter five hundred and fifty-seven of the laws of nineteen hundred and twenty four, is hereby amended to read as follows:

"In the general election held in the year nineteen hundred and twenty-five and every second year thereafter there shall be

elected a supervisor in each ward by the voters of such ward to serve for two years. In such election and every four years thereafter there shall be elected two justices of the peace to serve for four years. In such election and every second year thereafter there shall be elected in each ward by the voters of such ward two aldermen to serve for two years. At such election there shall be elected by the voters of the city at large two members of the board of education to serve two years and also then and every fours years thereafter four members of the board of education to serve four years. In the general election to be held in the year nineteen hundred and twenty-seven and every four years thereafter there shall be elected by the voters of the city at large four members of the board of education and a recorder to serve four years. In the general election to be held in nineteen hundred and twenty-five and every two years thereafter there shall be elected by the city voters at large a mayor and an alderman at large to serve two years."

§ 2. Section six of the present charter of the city of Middletown is hereby superseded.

§ 3. This local law shall take effect immediately.

LOCAL LAW No. 3*

A local law amending section seven of the charter of the city of Middletown, relating to the commencement and expiration of the terms of office of municipal officers.

Became a law September 8, 1924, with the approval of the Mayor. Passed by the local legislative body of the city of Middletown.

Be it enacted by the common council of the city of Middletown as follows: Section 1. Section seven of title two of chapter five hundred and seventy-two of the laws of nineteen hundred and two, entitled "An act to incorporate the city of Middletown, and the acts amendatory thereof" as last amended by chapter five hundred and seventy-seven of the laws of nineteen hundred and twentyfour is hereby amended to read as follows:

"All officers so elected shall begin their terms on the first day of the year following their election and their terms shall expire int the last day of the last year of the period for which they shall have been elected.'

§ 2. Section seven of the present charter of the city of Middletown is hereby superseded.

§ 3. This local law shall take effect immediately.
